Gamestop shipping opened games as new?

We all know that Gamestop B&M will sell you a open unsealed copy as a new game, but I've never had them actually ship me open unsealed games when I ordered new until now.  Stickers all over the cases, dust and fingerprints on the discs, one was even loose in the case.  Has this been going on for long?

Not sure why you are so upset. They saved you the trouble of having to open the game yourself. Now that's what I call service!

 
They've been doing it at least 10 years.   I remember ordering a PS3 game back in 2006 or 2007 for my brother.  Thing looked demolished.  But I knew it was "NEW," because it had a sticker on it informing me as such.

I didn't start receive "new" games from GS.com until a few years ago. Before then, anything new I bought online was actually new. This coincides with them having stores ship stuff out directly now so I guess that's why. 

Pretty annoying but it's not like you have much recourse, other than to return it. 

 
I don't see how there isn't a class action lawsuit against GS for this shit.

You buy something new...they send it opened. Ok fine grey area since new just means unused, they never said "unopened" ok fine. Then we get "new" with fingerprints on the disc...OK fine stretch the fine line even more because while it may have finger prints it was still never used....can't be proven it wasn't but whatever.

Now we get shit that is MISSING stuff! THAT IS NOT NEW. And to go even further we get games without cases at all, just the lose cart/disc. That's so messed up and I am not a lawyer by any stretch, but that has to be illegal. Sure we can return it, but you have to jump through hoops to get your money back all the while GS is sitting pretty.

I just got a game in the mail yesterday that was meant to be brand new. It arrived in a case that looked like it had been to a couple homes, and sat on the store shelf for months. There were no price or bar code stickers on it, and whoever put the disc in didn't line up the case correctly as he/she closed it. Then sealed it off with one of their clear stickers.

To me, this is 100% USED, and I paid full price for it. I could have gone to one of the local stores and got an open game in better condition, and not spend the money on shipping. Can't order the game online, unless I want to spend almost double the price for it. Yeah, it's one of those games that Gamestop has the lower price on. Can't check to see if the disc is even the correct one, or if it's scratched, because taking that clear sticker off will automatically make them claim I opened a sealed game.

Never had an issue with them like this before. In the B&M locations I simply walk out if I'm buying a new copy and they don't have a sealed ones. Often I'll have them check one of the multiple stores nearby to find someone with 2+ inventory. If I'm buying new online, I expect it to be sealed. When buying used I'll only buy from a B&M location, or from a place like eBay that shows the condition of what I'm buying. I'm a collector, and as such I'm not paying for scratched up games or damaged cases.

Oh, there definitely should be. But their CEO will use the comparison of test driving a new car and it still being new when test driven... because, you know, cars and video games are totally the same thing.

And here is a guarantee. If eventually Gamestop by the courts is ordered to stop doing these practices, then they will make up for the lost dollar amount in other ways. Ways that hurt the customer. They'll make up for it in customer service or shipping quality cuts.

So I contacted Gamestop about my game. Told them that the condition was unacceptable,  and that I wanted a sealed copy for the money I was paying.

The answer back was "Sounds like you have a defective item. Please let us know exactly what the items was, and if you want a refund or replacement". Told them I wanted the replacement. A week went by, and no more information on it. Messaged them, and a couple days later I get another email saying that they recently shipped my replacement out.

So what arrived? Another unwrapped copy. This time with a clearance sticker on it, and that clear sticker on the top, bottom and side of the case. Looking at the clearance sticker, they printed it out the day before telling me a replacement was being shipped. On top of that, the game is rattling around inside the case.

They never asked me to send back the first copy. Makes me seriously tempted to return it for a refund.

 
I gave up on Gamestop selling me sealed games. I got Dungeon Traveler's 2 gutted/Gamestop New. Next I got two of my most recent pre-orders in the same condition, despite paying in full before launch day.

Getting one of these as "new" would probably stop me from pre-ordering/buying anything "new" from Gamestop. The final straw would be getting the generic case art and the unofficial/generic Gamestop case as "new."

Same thing as the linked item, just with one of those chemical smelling generic game cases that usually accompany disc/cart only at Gamestop.

 
Still happening. IMO, an opened game can never be considered new. Back to Gamestop it goes.

Watch out for a second charge. That's what happened to me. When I got a replacement for items that never came the first time.

This is why GS is forever my used game store and BB/Amazon is my new game store. At best I will preorder collectors edition from GameStop, because they haven't messed that up for me (yet).
 
i just find it funny that gamestop is the only place selling games that can get away with this shit. i seen customers accept these games as new. i guess they don't care since they were going to open it anyway. some gamestop employees get annoyed when they get the game and start ringing me up and i decide not to get it because the "new" item is opened. wonder if we are going to see ex rentals being sold as new i wouldnt put it pass gamestop.

 
This kinda crap is why I buy my new games from Amazon (not to mention I get all those gift cards!). If I was paying cash, I'd buy from Walmart or the local mom and pop (Gamers; I like them better for used games, too.). They seem to understand that "new!" is in the shrink wrap. ^^

Sorry Gamestop, the only thing I'd buy from you is systems, and only if you happen to either be the only one who has it in the area or you're the best price for it. ^^
