Mario kart 8 for Nintendo switch .... $35, in CL , wants PayPal or cash meet?..Legit or scam

Does such a thing as a digital, download code for MK8 in the eshop exist?..

A guys selling a Nintendo switch version of Mario kart by digital download code
He offered PayPal or meetup (CL)
He said he can send me /txt me the code in person at the time of transaction for cash or send $35 via PayPal
Thing is I can’t check the code if I meet in person
If he scams me does this qualify as digital goods undelivered ? Or it’s money lost

I wouldn't do it though. can be easily scammed. 

I'd only buy a digital code from a guy (instead of a store with a CC) if it was under $5. That why I could stomach the scam or be happy it worked.
