That's an understatement. He's made numerous false claims, such as Microsoft being able to force the deal through by taking the CMA to trial and winning in court, which isn't an option in the UK. Microsoft could win an appeal with the CAT, which just lets the CMA make the same decision again.

CMA claimed this was about Call of Duty so MS offered an unprecedented 10-year deal for COD to anyone that asked for it. When MS made the CMA look like fools they pivot their argument at the last second to block the deal based on Cloud market concerns? Now Boosteroid and NVidia have released statements coming out in full support of MS/ABK merger, both are no longer getting Call of Duty and Activision games thereby weakening their Cloud service. Instead of increasing competition, CMA have killed the Cloud market. Now what!?
In their 420 page report, they claim that MS has not sufficiently proven that they can get Call of Duty working on the Switch. WTF!? Since when did CMA become developers? Then why would Nintendo agree to a 10 year deal then? Firstly MS doesn't even own Activision yet, secondly they got DOOM Eternal running on the Switch, thirdly, MS never said that they would bring COD to the Switch. Nintendo's next console (Switch 2) should be right around the corner. This sounds like the CMA is just grasping at straws here throwing shit at the wall and seeing what sticks.
Blocking $69 billion ABK deal over a small non existent Cloud market sets a bad precedent. It basically means the CMA can block a deal for any reason they make up not based on reality. What's stopping the CMA from blocking MS from acquiring Sega and Angry Birds? You think those P0nies are going to want to lose their beloved Persona and Yakuza games?
Yes it's true that if the Competition Appeal Tribunal sides with MS and the appeal succeeds, it goes back to the CMA but they are no longer allowed to use the same argument against the merger. They'd have to find a new argument to cock block the merger and their original argument is already weak as it is.
