Wouldn't that just mean that other companies wouldn't be able to use the phrase for advertising? I would think the fact that it already includes a trademarked product name would cover that.
 
I would think since they already own Donkey Kong, they don't need to bother with this. In any case, I'm sure they're doing it to try and stop someone from using the phrase in another shitty romcom or from printing it on shirts and merch.
