I just came from my local kmart store earlier today and they had it on the shelf for sale and when I took it to the front they refused to sell to me. I talked to the store manager and he said that if he sold it to me the store would face a $20,000 fine for selling early. I called corporate kmart and they offered me a $30 gift card. I contacted better business bereua to tell them my story and possibly get them for misleading the consumer but they are not affiliated with them apparently.
 
so...you got a $30 GC...which coupled with the $20 gaming coupon you get when you buy it next week makes it pretty cheap...and you're complaining?

I tried to post a pic of it on the store shelf but apparently since I'm a newbie it won't let me. But my thing is if it's on the shelf for sale they should sell it. It's their mistake. Be it a fine for $20,000 mistake it's still their mistake and should honor it. But that's not what really got me angry about it,it was the way the store manager dealt with the situation. He said if I complain to corporate he will just undermine everything I said and make it ok. He said there is nothing I can do as a customer. That's when I got peeved.
 
What he said is wrong. But, then again, threatening the manager and telling him he has to sell it to you is wrong as well. Most stores display dummy boxes of currently unreleased product. The boxes are sometimes actually real duplicate boxes of what the game actually looks like. GameStop had those boxes to represent Halo: Reach and they receive that game almost 3 weeks before the launch date. That doesn't mean you can demand that they sell it to you.

My advice is to ignore store manager in stores like Kmart, Walmart and Target, you'll rarely see them anyways. You should take the giftcard though. Besides, the Kmart deal won't be activated if you buy it before the game is in the system. Most likely the system won't let you ring it up on the computer anyways. It'll say "this game is street dated XX/XX/XX and cannot be sold at this time" and the transaction won't work. Quit complaining, grab that giftcard and wait. ;)
 
It was definitely not a dummy box. It was the actual item and after manager was notified they immediately removed all of them off the shelf. If there was one on the shelf I could understand a mistake but they had at least 7. Two or 3 for each system,ps3,360,wii.
 
So, a stock boy made a mistake. It happens. Their computer probably wouldn't even let them sell it to you if they wanted to, due to a street date restriction. Once you brought the mistake to their attention, they fixed it. They don't have to sell you anything. If you don't like it, just don't shop there. Don't know what else you're expecting out of this.

Even so you can't force someone to sell it to you.

Telling the manager he has to sell it to you is just going to piss him off. If he got flippant with you it's probably because this is just another crappy thing that he has to deal with in his everyday life of crappy experiences.

You were offered a free $30 gift card, take it.

The computer wouldn't let you buy it anyways. They're not going to let clueless employees cost the company $20,000.

The Kmart deal wouldn't even be active, you'd be costing yourself money and if you go online with the early released game you risk the ban-hammer for breaking street date.

This thread is funny. I would've just taken the $30 gift card and been done with it. Then again, I wouldn't be there for Simon: Warriors Of Rock.

That's all Guitar Hero and those 'rhythm' games are anyway, press the corresponding colored button to match the on-screen prompts.
 
They have this game on the shelf here at meijer if you want to take a crack at that one buddy. They even have Final Fantasy XIV for the PC(non collectors) too.

I took pics when I went earlier because I thought it was funny they had it out already.

The only thing that gets me steamed is that they offered him a free 30 dollar giftcard for something that isn't really a problem at all. Makes me think I should complain more.

In 2007 many long-time CAG's will remember KMart's nationwide put out Mass Effect 1 on sale 2 weeks before its street date. I went to a KMart near a friends's house and bought all 3 copies on the shelf. 1 to play immediately then sell once my CE from Gamestop.com came in, 2 to sell sealed immediately on EBay.

I paid for the games and the employee was handing them to me after bagging them when another employee grabbed the bag before I could and said I couldn't have them and they would have to refund my money. I didn't have my cell phone on me (it was in the car) otherwise I would have called the police to get the games I paid for. I tried to explain to them it was too late and even if they returned them it wouldn't matter in Microsoft's eyes but to no avail.

I was escorted to customer service at the front of the store where I was issued a refund on my card. I swore off KMart and went 2.5 years without going into another one until the current KMart regime convinced me to try the one near where I live (a different one from the ME incident) and they're pretty awesome.

IMO they shouldn't have given you anything. Be grateful you got a $30 GC because some employee screwed up and may have lost their job.

Yes it was on the floor, and unfortunately mistakes happen. This is why the store tries to make it up to you by giving you that gift card. As far as I'm concerned, they fulfilled their end of it.

The fact that you're still bitching about this means that maybe you're just an asshole and big freaking deal you don't get the game early. I have a strange feeling you were probably just going to flip it anyways, or you can't brag about it to everyone you got the game early, so instead tried to make up a sob story.

Get over it, be happy they gave you a gift card instead of a bitch slap, and move on.

He wouldn't be banned for playing it early since he bought it at a retail store. Even if he got on Justin.tv and started streaming video of it this weekend and Stepto himself came on the feed, all he had to do would show his KMart receipt and stepto's crew couldn't and wouldn't do jack squat about it. If he got it off EBay or pirated it, different story.

So they refused to sell you the game before release date and offered you a $30 GC? And the FIRST THING you could think of was to run home, join CAG just to tell us about it? Yeah, I'm just not buying it.

You serious? And you couldn't snatch that shit out of his hands? I can't believe you took that lying down. They spit in your face and you wiped it off with your handkerchief is what happened in my eyes. Wasn't Mass Effect going for $150 on eBay, too? I couldn't find any at my local K-marts so I gave up.
 
You should have just took the receipt, went to your car, called the cops and told them that a store employee just robbed you.

See i wish something like that would happen to me. I'd tell them to give me back my legally paid for merchandise or else you'd be calling the cops for theft. Or i'd just grab it back and walk out. If they so much as lay a finger on you then you can sue their ass.

I'd pray they'd stop me from leaving the store. Then you are looking at assault, unlawful detainment, and a slew of other charges. Know your rights people.

Once money has exchanged hands YOU are the legal owner of the games. They can REQUEST you return it but you are under no obligation to do so.

- Threaten to contact an attorney and start a class action lawsuit
- Go back and have a conniption at the customer service rep who probably wasn't even working that day, ask to talk to a manager, and make a complete ass out of yourself again

I had to comment on this last thing. If you get a game early from a store that broke street date, there is no risk of getting banned for playing it online.

If you bought a copy of Halo Reach 2 weeks before release because some little mom and pop shop was selling it, your fine, go play it online and don't worry. It's only the illegal/download copies that get banned.

If you understood anything about retail, you would understand how easy it is to make a mistake like this (especially at Kmart). Then you would begin to understand how much of an asshole you are being; making demands of the store, its managers, corporate, and the BBB.

As for the OP, stfu and take the damn gift card. Let me guess, you are one of those people that buy a burger from mcdonalds and return it because it doesn't look like the picture exactly 100 percent

If you get something early then great, if you don't then stay off of your little soap box and stop demanding that a retailer take a 20k fine just so you can play your crappy Guitar Hero game a week early.
 
I had a similar situation last year with RAtchet and Clank at Sam's Club, except it was only two days early. The manager offered me a $25 gift card for my trouble, I took it, and that was that.
 
A Sears I was at today already had a copy of :360:Dead Rising 2 and multiple copies of GH: Warriors Of Rock out on the sales floor. Dead Rising 2 was in a boxload of games and other assorted crap they were moving around the store and the copies GH:WOR were the guitar bundles and on a flatbed cart in the middle of the tv section.

But at no time did I feel obligated that they had to sell me a copy because both games were out in plain view.
 
You called the BBB on them for this?! That seems a bit harsh man! Just because they wouldn't sell you a game before street date?
