NES games factory seal... and opened?

Saw this auction in the ebay listings on the front page...

Nintendo nes game in factory seal. The box is sealed except the top so i could play the game. Box is in mint condition.

So factory seal refers to...what? the plastic baggie the game is in? And the box is sealed, except for where it's not? Awesome.

It's saying the original factory shrink is still on the game box after it was opened, but that is still retarted.

I honestly expected to see something like this in the auction "yes the game is in mint besides the coffee I spilled on the box, otherwise mint though".

I hate those types of listings. Even more annoying is one or two sellers who sell a ton of games are listing stuff as with a title like this: (game name here) NEW*

Then in the description it says the game is brand new but the case and manual are not included, they were damaged.
