I agree 100%. It's illegal for companies to charge a "sales tax" when they are not legally required to. I'm going to contact the publisher and ask where their physical Colorado location is. Unless they have a physical presence in your state, they should not be collecting sales tax from you.

I think it's double moot for me, since my state doesn't even have a sales tax at all. Even if they had a physical presence here, there's nothing to charge. I've never once been charged sales tax for an online purchase.

Mmk. But there's states with no sales tax, and states with different sales tax rates. Use tax also goes to your state, not just California, like this case.

I'm not following; why would a small business or sole prop file use tax? Use tax if for individuals using the item... if you're buying an item to resell you certainly are NOT using it and if you're using it for business purposes it is almost always going to be tax exempt (depending on how your business is set up) or at least a write-off. I get that some people file using their SSN which complicates things since business and personal transactions aren't always easy to separate but the biggest issue with use tax is individuals buying high priced items from Amazon or across state lines and not reporting and paying tax on it. Only a matter of time until a program is developed where the IRS can automatically see that.

There are other areas as a small business I'd be more concerned with filing correctly then this.

But back on topic, what store are people complaining about now?

Keep in mind that there have been many acquisitions lately (i.e. ThinkGeek running Tree House Brand Stores and GameStop buying ThinkGeek) and many storefronts switching distribution companies so although the small company whose game you bought may not have a store front in your state the distribution center many, or the warehouse may be there.

Also, if you're being charged the wrong tax rate my experience with many of these small shops is that they INCORRECTLY try to collect tax on the shipping and handling fees.

Hm... kinda torn here. I love Uncharted and all, and would love to have the LE... but kinda hard to justify the steelbook and artbook for $30 more (after conversion and shipping). Plus, I already have the UK special editions for 2 and 3 (don't believe there was one for the first game).

Will probably keep an eye on this. Maybe the price will drop but maybe not, since the Amazon.de exclusive LoU Remastered LE hasn't dropped at all since release.

I had to share this with you guys here, and I know I am going back a week or so so I do apologize. I remember the girl who had her Fallout Anthology come to her soaking wet from Gamestop. If you think that's bad, you should check out how my REPLACEMENT copy came from Best Buy. Check out these couple photos:

I have more photos but sadly they were too large to upload. Funny part is the outer box was not damaged at all, so whomever packed and shipped this did so in the condition I received it in. The employees at Best Buy were shocked when I brought it in last night lol.

Jeeze. BBY is getting really really shitty with their shipping lately. I get stuff damaed more often than decent shape these days. Its absurd.

Gamestop will re-shrink wrap opened games and sell them as new. I used to work there and do it years ago sadly. Was part of the job.

I still dont get how this is friggin legal. If you go to any other store and buy a piece of electronics it has to be new. Opened crap is usually sold as 'open box' at a small discount. God i hate gamestop

When I saw the steel in person I immediately fell in love. The thing is gorgeous and is just such a nice addition to my collection. Can't wait to have the uncharted 4 one next to it on display.

Also, if you're being charged the wrong tax rate my experience with many of these small shops is that they INCORRECTLY try to collect tax on the shipping and handling fees.

Not just small shops. Try walmart.com too. The last few times I ordered they charged an extra $0.30 tax because they included the shipping in the taxable purchase amount. Kind of ridiculous that they can't get that right.

Whether or not shipping fees should be included in the taxable amount also vary by jurisdiction (mostly state-by-state, but sometimes even by county or city). It's a mess.

Pretty much, I Pre-Ordered FFXIV Heavensward CE, and it never even made it to my house. UPS returned it back to them and then I had go out of my way to contact them for a refund after they received it a week prior.

I am hoping they don't screw up my Dragon Quest CE this time. If they do I'm done with them.
