Here is an account of the horror I went through with overstock.com. I post this in hopes of helping others avoid their company, and their attrocious customer service. I appologize for the length/grammar, but I'm kind of writing this in a hurry.

I bought a 360 on launch day. On december 27th my newest 360 red ring of deathed (this was my 4th) and I was sick of dealing with it, so I decided to send it in for repair, and sell it when it got back to help recoup the cost of buying an elite system.

ordered an xbox 360 elite (order #62740151) on december 28th 2007 for $449.95 plus $2.95 shipping. I ordered through a website called fatwallet.com because they had a deal that ordering through them got you a 4.0% cash back rebate on orders through overstock.com

on 1/7/08 my wife got a box from UPS and called me to tell me that it was too small to have an xbox in it. I called ups concerning my xbox package thinking that this was some other item, and they told me it was delivered. I called my wife back, and she told me the tracking number on the package, and it was the tracking number for the xbox. I had her open it, and inside she found a "Nyko Xbox 360 Intercooler" worth $18.50 from overstock.com. The packing list stated "xbox 360 elite system - $449.95", but the box was far far too small to fit that item, and again, only an intercooler was in the box.

I called overstock.com and told them what had happened. The associate was apologetic, and said he would put me in touch with parts to get my xbox sent out right away. I talked to a lady in parts, and after some discussion she agreed to overnight me an xbox 360 elite system tuesday, and I should get it on wednesday. She also said that my 4.0% rebate would probably not work anymore, so she would credit my visa back $20 for the inconvenience.

Tuesday around noon I notice that a second order number is on my account for an elite 360 from the night before, but that it is allready cancelled. I open the live chat and inquire when my 360 will be shipping. The associate apologizes and says it will not ship for a few days, and that it will ship standard shipping when it does ship. they also say I was credited $20 in in-store credit for the inconvenience. I check my account, and I see no extra $20, just the one for the rebate mistake. I tell him thats unacceptable and that I will call in.

I talk to a rep, and he says theres nothing he can do, and thats the way it will be, and the people from the night before never wrote any notes about overnighting or shipping out next day. I say I want them to just cancel my order then, because I wanted the xbox for this week to play with my little brother visiting from mass (i live in fl). He says he cant give me a refund until I return the intercooler they sent me. I say thats not fair to hold my $450 hostage over a $20 item, and he says theres nothing he can do. I ask for a manager, and he reluctantly transfers me after telling me the manager wont be able to help me.

The manager was exteremely rude, He asked me if I would mind being put on hold, in the middle of a sentence, and I said "yes I would mind, I'm talking" and he put me on hold anyway. I then start yelling at him when he came back on for cutting me off, and he hangs up on me.

I call back, get a different manager, whom again cannot help me, but is much more customer friendly about it. In the end I just have to wait for them to finally send me a return label, then for them to issue a refund about a week after they get the wrong product back.

I filed a complaint with the BBB, and ordered a new xbox 360 elite from amazon, which will probably be getting my business from now on. This whole thing has been such a nightmare. I just wanted to let CAG know what happened and maybe help some people avoid this wretched company.

Sounds horrific.

This is why I'm just waiting for Costco to get some elites in stock when I purchase my (next) 360.
Simple, reliable, and great warranty.

I'll feel bad when you have to go through all this trouble again when your new elite breaks =/

overstock.com has been good to me always.

ive never had problems with anyone besides family video.

meritline.com shipped out my order an hour after I ordered it, and it was on my doorstep in 36 hours (I paid $5 5 day shipping), but I hear bad things about meritline ,too...

point is I dont think this should be looked upon as the company being incompotent, you just got unlucky, really; they only made one real mistake, and the customer service was of course predictably stubborn, and yelling didnt help im sure...

Ah, good, you filed with the BBB. In all my dealings with companies where they were looking to screw me over, a BBB complaint always sets them straight.

they made a bunch of mistakes. Sent wrong product, promised replacement in certain time, told me they credited me for reasons they didnt, lots of thing. The yelling didnt start until he rudely cut me off while I was telling him what happened.

100% serious, I couldnt tell if that was sarcasm or not.

amazon, is just plain freaking awesome, hands down.
the $80 i paid last april for prime paid off...anytime i have a problem with electronics, they've always sent me a new one THEN told me to send back the problematic one. (this was back when i ordered my zen vision m; it was $300 back when i ordered it...so cant say how they'd handle an error with a 360...though $300 and $400 arent too far away anyway...)

overstock, sucks ass. i ordered a necklace, got a shipping confirmation, never got it. they said "it's on its way", that i should wait. 2 weeks later, still nothing, they had to send me a replacement. 1 week later, it arrives. but in pieces.

just thought id share why i have a disdain for overstock as well.
though obviously your experience was much worse than mine. you should burn that manager down for being a total asshole. write a letter to corporate or something.

they sent me a survey and I made sure to severely blast them. I am planning on writing a letter when I get the address of someone high enough in the corp. That necklace thing does sound awful too, I ordered a ds lite crimson/onyx that was defective from amazon once, and they did the same thing, overnighted new one, then asked for the bad one back. I only went with overstock for the 4% rebate, but it was OBVIOUSLY not worth it. amazon+free shipping+awesome customer service > any price break

I'm being 100% serious. A BBB complaint is a retailers kryptonite it seems.

You should have kept the damn intercooler and opened a CC dispute. I know it's a term that's thrown around lightly (and oft-abused), but in this case you would be justified. You paid $449.99 for a product that was never sent, regardless of the "2nd" shipment that was promised to you.

Overstock blows ass. They charge you immediately regardless of when they are shipping your item, you can't cancel ever, and really they just suck.
Ah, good, you filed with the BBB. In all my dealings with companies where they were looking to screw me over, a BBB complaint always sets them straight.
In my ONLY dealings with the BBB, they completely sucked ass. I had a friend(then gf) do one of those 'free item' offers from the net. She was supposed to receive a PC for doing THREE offers. So, she did the three offers and waited about 2-3 months until the completed offers showed up on the correct page, then she tried to get the free PC and all hell broke loose.

The company stated that it was SIX offers, NOT three and that she had to do three more offers to receive a PC. She had done other offers from them prior and received the item(s) very quickly. But, they were adamant about this situation and that she had to do more offers to get the computer.

So, I filed a complaint with the BBB on her behalf(my behalf too, since it was to be MY PC she was being f'd out of) and after repeated nearly futile exchanges back and forth with the BBB from the area the company is in, it was listed as 'settled', when in fact it NEVER WAS.

I sent in screen prints of the original offer page, complete with the full webpage listed at the top AND bottom of each page. I sent in full prints of the offers page, stating that only THREE offers were needed and yet the BBB took THEIR side of things.

I felt I argued my case properly and the BBB basically said 'they're right, you're wrong, case is settled' and that was it.

So, imo, the BBB is a crock of shit. File a CC dispute and get the amount charged back to your CC instead of waiting for 'The O' to get around to admitting they f'd up.

Amazon is top notch, especially their customer service. Only time I buy elsewhere is when I feel like using google check out on buy.com for the 10$ off.

Find out where the overstock.com headquarters are and file a complaint with that state's attorney general.

its gonna be hard to do a chargeback because they allready refunded me $20 for the rebate issue...those sneaky bastards are always one step ahead.
