That was the part I take exception to. Just because it goes on doesn't mean those of us who buy our games should have a lesser experience because of it.

Piracy goes on in a lot of industries. Consoles have it too. It's extremely rampant for television and movies. Game of Thrones is one of the most pirated shows ever. Does that mean they should go 'Sorry, we're losing so much money to piracy we're going to cut costs by filming on green screen'?

Because that's essentially the line that PC gamers are being fed, or at least that significant effort is not being put into our products, even though a significant number (that is higher than 5%, thank you Ubisoft) pay for them.

And with that, I have to go to work and get stuck with my only connection to CAG being phone in a building where I get crap reception for the rest of the day so if you want to rebuttal and win at the internets go for it.
Yeah I don't disagree with any of this. I even acknowledged that I think Ubisoft has crappy practices. I wasn't arguing with you with my second post just clarifying my point. Ubisoft's way of handling this is terrible, but on the flip side that's not a defense for piracy

Yes, Napster helped "lay the groundwork" for digital music sales -- after costing the industry billions of dollars.
There is absolutely no proof of that. This "industry" is something I was involved with on the indie level. I worked with people who were on billboard charting albums, hell one guy (and I own the rights to one of his albums), got an Emmy nomination for the Justified theme song. I have experience with being just outside the fringe of success. If anyone should be shaking their fists at piracy, it should be I. I alluded to having albums that I played a part in, that I had for sale, being pirated, and things were not financially successful for me! I backed out of my involvement significantly, but I know damn well better than to blame piracy for that! I wish there had been more piracy, because with that would have come more money and success. Popularity is the catalyst for success.

The move towards MP3s has unquestionably hurt album sales. Yet, the numbers show that more money overall is being generated! That lost billions nonsense is built on the ridiculous notion that everyone who downloaded it would have paid. One of my former artists, recently put out an album with several fairly popular underground acts (Hopsin, Mastamind from NATAS, Lord Infamous from Three 6 Mafia), but within months he released it as a free download. Did he blame piracy? No, that wasn't the issue, the issue was he had been focusing on producing for too long and hadn't promoted himself well enough. So, he gave it away to fill the gap, a "service" that pirates do for more popular acts. He's paying money out of his pocket to get people to check out his music for free...

The music industry is more lucrative than ever, the movie industry is as well, as is the gaming industry. If piracy really was this horrible force of destruction, that would not be possible! If they had their way, there would have been no home videos, no MP3s... and they'd be making less money! Piracy prompts irrational behavior, and absurd assertions (like the notion that everyone who downloaded an album on Napster would have paid $10 for it otherwise). It simply is not that big a problem, and each time a company screws us over, and blames piracy, all they're really doing is screwing us over and presenting us with a scapegoat.

My comments about avatars was just to illustrate how things really are. We pretend piracy, really, really, really matters, but only in a few instances. It doesn't make sense to say it's completely harmless in one context, but extremely harmful in another context.

You guys should take the piracy talk to the Playfire thread.
But... this is the only thread I'm posting on, and I have nothing else to talk about.

And other artists, who were successful, have claimed their damages were significant. As I said, anecdotes and guesses. Speaking of bad arguments, this also turns black and white real fast. No one is arguing that piracy is 100% behind anything. It's possible for someone to be damaged by it and yet not have it be the sole primary cause of something else but rather one cumulative factor out of several. I can have a successful store with an employee stealing from the till but that doesn't justify his theft or mean I'm not harmed by it ("You're successful so it must not matter or hurt you!")

This heads back towards the topic though. This entire thing can really be summed up by the pay what you want phenomena. Although Stephen King is the first I actually recall seeing do that (and the numbers I saw showed a vast majority of the people did pay), some musicians took to that model as well. It can work relatively well, as you reach more people, and one thing we've learned is that even when presented with the option to pay nothing, or practically nothing, a lot of people still pay a fair price. Furthermore, a lot of people will pay a little for something they otherwise would have paid nothing for, and never used at all.

This of course goes against the notion that we're all heartless thieves. We like a good deal, sure, but the consumers have shown time and time again they're willing to pay for a good product. And, that's really what my entire point is. The companies want to make the consumer out to be an adversary, someone they have to beat, someone that is out to get them, and that adversarial relationship is really only on the part of companies like Ubisoft. The consumers on the other hand have been far too tolerant and generous to companies like that.

Also, cherry-picking. Metallica is not the only artist to make the claims. And an "increase in revenue" doesn't disprove damages; see previous example of employee stealing from a popular store's cash register.

I actually came across that when I took a quick tour through the greenlight section the other day. Just goes to show that people will put out anything and people will likely buy anything.

I just threw that video out there because it's new and for a game releasing Monday (Divinity Original Sin) that I really want to play. Seems the editor in the game is quite nice, so hoping to see a lot of good player-made content.

Sounds like Rebellion is pissed it keeps losing lawsuits all over the place and is now taking it out on it's consumers.

BTW if you don't know what I'm on about they're pulling the same crap King.com has been pulling and claiming that no game can use the word Rebellion in the title. They lost in the U.S. and now are trying to sue in other countries. Douchebags.

Pretty sure the issue we all have is simply that the response to piracy hurts legitimate customers. This is what I think it boils donw to in this thread. We are all paying customers and DRM can make our use of the products we obtain legitimately more difficult or onerous.

Companies like CD Project Red (The Witcher devs) recognize this and choose to not add DRM to their products for this reason. No matter what they do or how much they spend to combat piracy, the product will still be pirated. Adding DRM hurts the consumer and does little to slow down the piracy. It may curtail casual piracy (i.e. I install this at my friend's house), but the kind of mass distribution that ultimately has the impact on devs and publishers will circumvent the DRM pretty quickly.

My biggest fear is that when I purchase a game, I would like to be able to play it in perpetuity. If a company that institutes DRM, whether it be Ubisoft, Steam, or anyone else stops supporting that product or goes out of business, that could render my purchase unusable.

So ultimately, piracy hurts us as consumers as well as the devs and publishers (by how much, I am not getting into as this is unknowable). However, the kneejerk responses by publishers such as always or draconian DRM is not the answer. I think GabeN is on the right track when he suggests that offering the better service where buying the product at a fair price is easier than pirating the product, then Piracy may begin to decline.

All that that proves is that other developers don't enforce or check for valid keys. There is always a risk when buying from unauthorized stores, especially if you "go for the most cheapest"

I mean, if you're gonna bitch and moan at least pretend like you didn't do something you weren't supposed to do. Admitting he got the key from a cheap, unauthorized online trader just validates the devs.

This. Not even sure what the shitstorm is. Do these people really think Rebellion chose to sell really cheap keys to shady sites and then went back on their word?

I wasn't trying to defend the guy, by "best" I meant most ridiculous post ;). I agree with what you're saying. I don't understand why people didn't buy AMD codes if they were going to be that cheap, probably would've costed less and they would have gotten more games with it.

This isn't a proper IP it's just a single word out of the english language. It might be considered a problem if people were using their company logo or made a new company named the same or something but this is literally just you can't use that word in your title.

If people are allowed to claim isolated words from the english language as an IP then it's only a matter of time before no one can name anything or even speak the language without having to pay exorbitant fees to several different companies all the time.

 



So ultimately, piracy hurts us as consumers as well as the devs and publishers (by how much, I am not getting into as this is unknowable). However, the kneejerk responses by publishers such as always or draconian DRM is not the answer.

Actual counterfeiting is different entirely though. While I don't condone digital piracy, actual counterfeiting confuses a legitimate consumer into purchasing an illegitimate product and that is something I do think is more than just a boogeyman.

It's a trademark issue, not copyright, which is why one word can be involved and it's not Rebellion being a big bad wolf and trying to own a word, it's them challenging any uses that might dilute their trademark, cause them to lose it, and then risk having to invest time and money in a new one.

Sure. They spend money developing cumbersome DRM schemes just to fuck with us and because their development budget was looking a little too full.

I'm not saying the schemes work or aren't a pain in the ass but let's not pretend that the catalyst for them is anything besides stopping piracy. No pirates = No need for the DRM.

They already lost the case though. It was alreadty determined that the use of the word in the properties in question would have little to no impact on their trademark. Filing new lawsuits in other countries in an attempt to circumvent the Supreme Court is a bit vindictive.

Yeah, they lost in the US. So now they're filing in other countries just to keep up the fight. It screams of being a sore loser.

If they couldn't win in the US, I doubt they'd win anywhere in Europe. Dunno about Canada's policies.
