Xbox Live headset question

I wasn't sure if my broadband satellite was supported by xbox live, but a couple of weeks ago I found a 2 month trial sub and decided to give it a shot. Suprisingly it worked, but I don't have a headset and probably won't buy one since the 360 premium version is suppose to come with one.

I was wanting to know if there is a way to display to other xbox live users that I don't have a headset or voice chat, so they know I'm not just being rude when they talk to me and I don't respond back. Thanks for any help.

Also any good cheap Xbox live game recommendations are welcome. All I have been playing at the moment is the Battlefield 2 demo, and I just picked up a free Pandora Tomorrow today.
 
Most XBL titles actually show if you have a mic plugged in or not plugged in, by means of a small mic icon near your name in the game lobbies and the like.

Beware, however, as assholes feel more inclined to talk shit to you if you don't have a mic, as you cannot say anything back.

But he would need the adaptor for the controller to use a cellphone headset.
