I think the key here is that the chipped discs almost always work. It's a cosmetic issue, and a pretty minor one.
The only way to fix it would be to reinforce their mailers, which would increase the cost of the mailers themselves as well as the shipping costs. Every used game you're buying...
It's not illegal, just a voluntary program. The ESRB has no power over retailers. They've only done this in the past AFAIK to gather statistics, as discussed in their FAQ.
