Why don't you guys try complaining and trying to get the guitar first before returning the game. I would think you have a strong arguing point that it said the guitar was included.

As a pre-emptive strike (seeing as one person got it so far, it's likely to be the same for all of us), I sent an email to B&N customer service. I'll let you guys know as soon as I get a response. My goal here is to get the guitar controller OR get a new bundle without paying any extra, so if the email doesn't work for B&N I'll try calling B&N or GS directly. If all else fails I guess we can just get our money back :/

Grrr, the just sent an automated response about their return policy. I'm going to wait till mine arrives then email Gamestop directly.
 
NEW UPDATE: Well, I contacted B&N about this and they told me because it's GSs item, I have to call them instead. After about 20 mins of holding on the line for the GS customer representative, I'm told the only thing I can do is return the game for a refund.

Because the guitar is not sold separatly, they can't just send me a guitar or a new bundle.
 
This is seriously fucked up if we let B&N get away with this. It specifically says ON THE RECEIPT that we will get a GH w/guitar. If mine shows up sans guitar, I am not going to get off the phone with B&N until they either promise to send me one - possibly via an entirely new GH - or they cough up another 30 bucks and let me at least feel like I got the game + the guitar.

This is some serious, serious shit. We shouldn't have to go through GS at all.
 
this sounds bad. I used my debit card, so I can't even refute the charges. But here's what I'd do: If they say they can't send you the guitar because they don't sell the guitars seperately, then ask to return the game in exchange for the bundle (which you're already entitled to). Whether you keep the copy of the game that they send you or the bundled copy is trivial. Either way it would be an infallable argument. I'll call 'em up myself after my game arrives in the next few days.
 
Question: If the game comes game-only and they refuse to send a guitar, how does one go about returning the game? Can you do it at a Gamestop B&M? Or what about B&N B&M? If not, do they pay for return shipping? Because it would be royally evil of them if they expected us to pay to return something that they screwed up on after withdrawing $40+ from our accounts for a couple weeks.

If the return is done through gamestop.com like I would think it would be, according to #3 they would refund our shipping cause it's their error. So...at least we know we have the option of getting all our money back, but I doubt not we can get the guitar we rightfully deserve. Where there's a will there's a way they say :p.
 
I got a email response from gamestop (I guess B&N mirrored it to them).

Here's what I sent
The item clearly states that the guitar controller is suppose to come
with the game, but I only received the game. I ordered the item
intending to get both included, so I expect to have both. How may I go

well I ended up getting Guitar Hero Guitar only loally for 10 bucks now all I have to do is get the game. I'm sorta the oposite side of the boat as most of you guys. Sucks that Gamestop gave you a contradictory discription of the item. Anyways whenever ebgames or gamestop has the game only up for grabs let me know, I can't wait to use some online coupons :p

also if anyone wants to trade the game only guitar hero for like Project Gotham Racing 3 for XBOX 360 hit me up with an offer.

Lucky, I did a search on gamestop.com for a used guitar hero controller, and there's only two stores in a 200 mile radius. The closest of these is 87 miles away -_-.
 
heh I eneded up trading some stuff for the game so now I have a complete set:p Now I must look for another guitar for a 2nd player. I tried using the gamestop.com search yet I doesn't come up with anything do to some error.
 
Received my game today. Notice I said game, as in game-only. fuck you Gamestop. Now I'm going to have to waste time trying to get this fixed.

Has anyone else in this same situation heard anything to our benefit? I don't have the time or patience today to deal with this (it's 4:23, I've had to deal with a lot of bs regarding work today, including a broken router, broken laptop, and shitty post office), so I'm going to hold off until tomorrow before I start calling and bitching to BN and possibly GS.

Anyway, has anyone heard anything? I think all of us want the entire bundle, even if it is used, and do not want to put up with the trouble of getting a refund.
 
Finally got mine today, and as expected it was the game only. What REALLY ticks me off is that on the reciept that's included with the packaging, it says that I ordered Guitar Hero (game only). They changed it in the process somehow, perhaps they caught their mistake? Grrr. I'm going to call here soon I think. My friend also bought it, and he's good with getting what he wants when there's a problem with an order and such, like he's relentless. So I'll see if he manages to get it fixed before I try.

On another note, on Gamestop.com's website they have the guitar only for $10 used. It's always out of stock, but use the search to find one near you. Even if there's one FAR away, you can go to your local one with the number of the store, and have them call that one and xfer it. It's free to get it transfered to a different store. So I'm getting one here soon from a store that's 200 miles away.
 
My game only came as well.... Don't have time now to call cause I'm leaving to go see Hostel. I'll call B&N tomorrow and complain ect. I will get what I paid for!

I am THIS fucking close to sending back only the case for this BULLSHIT.
 
Wow, they are "more than happy" to refund people who didn't get what they ordered. I guess they are also happy knowing they pissed off a lot of people.

The correct thing for them to do is either, give everyone a guitar or a new bundle (and have people return the game in exchange for the bundle) or give people a refund and let them keep the game for free.

Terrible to see the way they are handling this. At least when EBGames.com makes a mistake, they usually live up to them and honor it. I hope once the merger isn't complete, EBGames.com doesn't act like this as well.

Even though I didn't order the game because I was afraid this might happen (and it wasn't worth the trouble to me to save $20 on a game I don't need to get right away), I'm going to be very wary of ordering from Gamestop.com again. Actually, the last time I ordered from them, they cancelled my order due to a price mistake (it was that Colliseum game for $9.99 that was posted in early July)
 
I got the e-mail too. I think if they aren't willing to send the guitar, the least they could do would be to let me return it B&M so I wouldn't have to wait an additional 2 weeks to get my refund (it's already been 11 days since I paid), and then make it up by giving a $10 coupon. It wouldn't be as nice as getting the guitar, but it would at least be soemthing for all our troubles.
 
Same here, after talking w/ two reps today, no luck in getting the guitar. The used guitar controllers are on major back order and they wouldn't send me the new bundle or even let me buy the new bundle at a discounted rate or anything. The explanation I received was that the SKU that BN sent to Gamestop when this was ordered matched up w/ the SKU at Gamestop that was game only. While this is a plausible situation, it is inexcusable to not give the customer what they paid for.

I'm with you. I feel like I'm the victim of some sort of bait & switch scam. This can't be legal considering we paid (note: not order, paid) for the pre-owned bundle. I'm waiting on my pre-paid FedEx shipping info via e-mail. But it's total bull.

Can anyone who actually knows something about law confirm this is legal for them to do?

Ya this is fucked up. BTW my order was sent out over a week ago and I still havent recieved it.

My friend might have been the one to break the camel's back. He had the goal of asking to go higher and higher in rank until he got something. Well, the one guy said all he could do was get him a fedex slip, but he said he'd transfer him to his boss. Well, he transfered him to a vacant office so all he got was an answering machine, to which he left a nice message on.

I never really ordered from gamestop.com, so I never will again.

Edit: Did you guys realize it says "As of 1/20/06"...so they decided to prance around for 11 days for the fun of it?

That's what I'm saying. I wonder if calling a lawyer for some of that free legal advice the commercials promise would do any good? And then contact GameStop to say you have a lawyer? I dunno. Just thinking allowed.

Okay, here's the deal: If goldfinger 18 is correct and B&N sent GS the wrong SKU, then it is indeed B&N's fault. Gamestop, for whatever reasons you may hate them, was just going by the book and cannot be faulted in this case.

Barnes & Noble however, is in deep dog doo. Here's what I intend to do once my package comes in, and advise others to do:

Call B&N, explain what happened, talk to the manager, explain, yaddy yaddy yaddah... Then they'll tell you that it's not their fault as GS was the one in charge of shipping the game. Then you tell them that it was THEIR site that had the game mismarked; that was their first mistake. Their second mistake was sending the faulty orders to GS and not cancelling them. Their third mistake was not honoring their error. Read to them the FTC's definition of Bait Advertising on http://www.ftc.gov/bcp/guides/baitads-gd.htm (make sure to mention that it's a gov't website). Tell them that had they merely mismarked the item that would have been one thing, they could have still cancelled the orders. But the fact that they've taken our money means that legally we own the rights to a used guitar hero guitar and game, and right now they're in violation of that law.

After you throw this much legal mumbo jumbo at them, they'll practically shit their pants. it should work.
 
It's not that B&N sent the wrong SKU, they had the wrong description. There is no used guitar hero SKU at gamestop, so there is no correct SKU B&N could send. As far as I know, it could be gamestop's fault for providing a bad description.

I got the email like everyone else. It listed the number to call Gamestop's customer support. I tried this a few moments ago and got something that wasn't even close to Gamestop. Are they really that badly run?

I tried calling B&N CS but got computer after computer which it kindly stated I should call Gamestop because it's their thing or something.

My Best Buy has a lot of the game in stock for 70.... This is just too much of a hassel but I won't stop until I get a reply back from the email I sent B&N and until I reach a human being at these freaking places....

Quick update

Just got off the phone with B&N CS and they told me it does in fact state that it comes with the guitar. Does this mean the site still shows this error? Told me to call Gamestop CS and gave me a different number than what was in the email.... I'll keep people posted I guess... I so have better things to do than this...

Called GS CS and got the rudest woman. She claimed the error was fixed a week ago and she really didn't seem to care that I was entitled to my paid for item or not. She also said that the site itself states that they are not responsable for typos. I saw no disclaimer ect. So now I'm going to call B&N again and state what went on with gamestop.

Got off the phone with B&N CS again. Got a girl this time and she was very nice, aplogized but stated it's all up to gamestop to give me my guitar. I think I need to calm down for a smidge ebfore calling them because I will be complaining about the CS operator I spoke to last time.

Called GS CS. This girl was friendly. When she said they don't sell the guitar I said well your site says you do for 10 dollars, I searched for one enar me. Three places in 200 miles has them and that I don't see why they can't send one of those to me. She said she can't make that decision and sent me to the supervisor. I got her voice mail and left her a message saying what I told the girl, left my number and I am still waiting for the phone call... It has been half an hour now....

To GameStop's credit the rep was very nice and said she's gotten a bunch of calls about this. She also told me that since they are offering a full refund including return shipping this doesn't qualify as bait & switch.
 
How long do you all think it will take for this to drop? I thought about buying one at my BB, but after playing the demo while I was there I felt $59.99(after coupon) was too much for the overall fun factor. Granted it is innovative and I enjoyed playing the easy parts, though still challenging, but like others have stated when you get into medium and hard I felt it was unplayable. Maybe this is due to the fact I've never played an instrument in my life except for the recorder or I don't have as much rhythm as I thought. I do hope to add this to the ole' collection one day, but hopefully it will be around $25-30.

You'll never find it for $30 unless some store has some crazy closeout or insane pricedrops like the recent GameCrazy deals. Those rarely happen.

Best Buy, at least around here, has a ton of them at every store I visited the last couple of days (five in total). Once the hype dies down and people forget about it, I'm pretty confident BB will drop the price on these - after all, no one ever thought things like the DK Bongos and the Taiko Drum would go on sale, but they eventually did.
 
I'm giving GS until tomorrow to call me. I expect the call tonight and if it doesn't happen I will be calling them tomorrow the second people get there. It is rude what they are doing. She asked me if I would be home all day and I said yes, forced friends to return some vids to Blockbuster ect so I could get this call....
