If you buy a used game and are told they do not have the case or instructions, but later (the following day or so), you find out that they actually did have the box and instructions and you see them sitting on the shelf. Is it okay to take them?

I am not talking about discussing it with the employees beforehand. I'm not talking about returning the game and buying it again to get the instructions. I'm talking about taking the case or the instructions, slipping them into your pocket and walking out the door.
 
When you paid, got your receipt, and left with only the game, you agreed to the conditions of that sale. You were told you were not receiving the case or instructions and you accepted. So, no, it's not okay to go back and take them. It becomes a case of theft at that point.
 
Do they charge you for the case and instructions or the game?

If they sell games for the games themselves, which they do.
And they sell them for the same price whether or not they have the case and/or instructions, then the case and instructions inherently have no value and cost NOTHING.

How can you steal something that doesn't cost anything. Their terms of sale have nothing to do with items that they themselves give no value to.

If I take a Sony catalog on my way out the door is that theft? They don't cost anything, I didn't ask to take one, I just took one.

Of course that's not theft. How is that different? The stores themselves sell the games for the exact same price with or without case and instructions. They have no value whatsoever.
 
In my area, Gamestop always says on the games with no case or instructions, it's 10% off. If I had gotten a discount I would not take the case.

Had I paid for the game with no discount, I would bring back the game with the receipt and ask for a case if I saw they had it.

I would not take it without asking.

Although, I would never buy a game without a case or instructions so I don't think I will have to deal with that ever.
 
No discount at my Gamestop for games w/o case or instructions. The problem is they offer full trade in value for these games whether or not you are turning in the box or instruction...dock the trade in value and pass that on to the customer....

But if they are charging you the same price either way, there is no incentive for the consumer to not take a case or instructions when he or she bought the game there.
 
Definitely would not take it because I didn't pay for it. I have to agree that a store looking out for their customers would give them the box/instuctions if they found it later.

A couple of months ago I was at KB and I bought a "Onesy"(?) Zelda game that came with the instuctions, backboard, but all cam in a baggie. I bought it, but while I was waiting for somebody I took a look at the rack on the wall and saw that the Zelda box. I asked the guy who I paid, and he was more than happy to oblige. Granted there was no discount because it came without the box, but I was still able to get it later on with no problems.
 
I would say it is stealing to just take it. Granted I would taken my reciept shoved it in the employees face and then slapped the hell out of him for lying to me and tell them to give my case and instructions, but you can't just outright take something that you technically did not buy.
 
What you should be asking, is what would the cops do. That answers it right there. You ruled out the best answer anyways.. Im sure you could even pick up the demo boxes, etc from another store if you asked them politely
 
if their wallet was hanging out i'd take that too, grab my instructions and box and slap them shitty on my stroll to the door
 
besides, most employees would probably give it to you, maybe


Wow Tucks what Video games store do you shop at ? Most employees at Gamestop or EBgames could give a shit less if i got a box and manual with my game purchases .
