He got the footage because he was interviewing people who were going to work in Iraq. Nothing sinister there. That part was never included in the film because apparently it wasn't that interesting or important to him. Out of respect for the family of Nick Berg, he took the film to them and did not make a big public spectacle about it. And he didn't add it back to the film for cheap sensationalism either which would have been very easy to do.
