Actually, if you read the DMCA it is not legal. The game contains copy protection and you are circumventing the copy protection. That is illegal.

Who here is talking about using the mod for Xbox games, or downloading Xbox games? No one. So far, we've talked about homebrew games, applications, and streaming video. You're not circumventing copy protection on anything, you're not copying anything. You're circumventing their access control to run your own software, which is very, very different.

Oh.. and I can tell you that I bet they have never banned a machine that was not modded as a mistake. This would be a fairly simple task to execute and I fully agree with what they are doing. If you wanted to mod your system and play video games go buy a computer!
