Charter charging for HD even without an HD subscription?

SOmething I noticed on Charter cable. Normally, when you don't subscribe to a channel, you get a locked out screen. However, I can see a black screen yet still hear the audio on the HD channels. Are these supposed to be locked like the premium channels you do not subscribe to, or is HD basically active at all times but not viewable without the HD cable box?

I get all the "over-the-air" HD channels (ABC, CBS, Fox, NBC, PBS, etc.) and I only have a basic Charter cable subscription and no box or antenna. The HD channels they make you pay for are the cable ones like ESPN HD, Speed HD, etc.

Yeah, that's what I'm talking about. The sound comes through on what are supposed to be channels you need to upgrade to the HD tier to get.
