WASHINGTON – Rep. Dennis Kucinich of Ohio is suing a congressional cafeteria for dental damage he says he suffered after biting into an olive pit in a sandwich wrap he bought there.

Kucinich's attorney, Andrew Young, declined to comment Wednesday on the lawsuit seeking $150,000 in damages from companies involved with the Longworth House Office Building cafeteria. A spokesman in Kucinich's congressional office also declined to comment.


The civil suit filed earlier this month in the Superior Court of the District of Columbia said the wrap "contained dangerous substances, namely an olive pit," that a consumer would not reasonably expect to find in the product served. The suit said that Kucinich suffered "serious and permanent" dental and oral injuries requiring multiple surgical and dental procedures.

Kucinich's lawsuit said the Ohio Democrat bought the sandwich on or about April 17, 2008. He is seeking damages for "past and future medical and dental expenses, compensation for pain, suffering and loss of enjoyment and other damages."

The liberal congressman made an unsuccessful bid for the 2008 Democratic presidential nomination.

Two of the companies named in the suit, Compass Group USA Inc. and Performance Food Group Co., declined comment through spokespersons.

Having had ortho work done as a child and knowing what I do about dentistry, having a cracked tooth is no fun at all. The human jaw exerts a lot of force when chewing and can have serious injury if used on anything it shouldn't have been. Aside from the tooth, you need to deal with possible infection, the cost to save it, rebuild it, possible mandibular joint probblems, amongst other things. Is it worth $150k? I'm not one to judge someone's level of suffering on this particular issue, but it's not a small thing losing a tooth to an olive pit. We're not talking about a rock in a head of lettuce or sand in an oyster.
 
Don't congressmen get excellent benefits for their entire lives, including dental coverage? I would assume that all of his "past and future medical and dental expenses" would be covered by his insurance. Maybe I assumed incorrectly.

Seems like a weird distinction to make.

Frankly I think it's frivolous. The kitchen shouldn't have left the pit in, but Dennis needs to be careful what he chomps down on. Methinks the little guy is riding high on his Napoleon complex.
 
I thought most people knew there is a risk in eating things like olives or cherries, that sometimes the machines do miss a pit. I mean I've even bitten into an olive and hit a pit before, it happens. Sucks that it damaged his tooth, but that's the risk in eating them, unless you expect someone to go through and check every olive by hand.

I agree that what I say may seem strange, but some people really want to keep their teeth. I would be pretty fucking pissed if I bit down on something that shouldn't be there and fucked up one of my teeth.

In a number of legal jurisdictions, unless you file for a certain dollar amount in damages, the court will automatically and without review send the suit out of court in into arbitration. With that in mind, I don't know if DC has that policy in place, or what its minimum amount is to actually see a trial, but knowing this, it makes sense why we see civil suits with damages sought that are disproportionate (seemingly) to the harm caused.

Because the civil suits seeking a couple thousand in damages go to arbitration, small claims court, or Judge Judy.

Even if tort reform was a bill on the hill, it'd have a really tough time passing with all the lawyers working there.

Which is why most insurance contracts have a clause that automatically entitles them to to any damages you win in a lawsuit for anything they paid for. Furthermore, most insurance contracts have clauses that allow them to sue on your behalf if they have had to pay out any claims for an accident.

He may be asking for $150,000 but even if he was awarded that, he personally won't get all of it.

Don't get in the way of people trying to hate the courts system. Damn it, they give coffee spillers millions which is just wrong! Our civil justice system is a mess, we hate it, well until there's a claim we need adjudicated of course...

Its all those damn lawyers just milking us hard working Americans dry.

I cracked a tooth at a restaurant once because they forgot to pit an olive. It never even occurred to me to sue them. I just went and got it fixed.

I missed my big chance.
 
I don't get it. I'm Portuguese and the amount of dishes we have with unpitted olives is bothersome. Yet I've never heard of anyone cracking their tooth. Y'all either got some frail teeth or I hope none of you would even consider giving head.
