No deep scratches, (inspecting right now), when held at just the right angle under bright light I see two small lines on the right side of the touch screen. I haven't noticed them before, and I can't see them without bright light and viewing at a side angle. For all I know, they could have always been there.
I don't know if I can even call them "scratches"
I wish I could describe better, I totally didn't notice until just inspecting, but I want people to be able to make an informed buying decision.

The marks are so hardly noticable that I'd be wiling to "trade back" with whoever was willing to ship back the day after they receive the DS, if they are not happy.
