eBay: Broken Item Question

My wife sold a ceramic cookie jar on eBay.

Did not offer insurance w/ the shipping option.

Did not specify any return/refund policy if the item arrived broken.

Buyer has contacted her to claim it is broken.

Assuming the buyer is right and furnishes proof, is she liable for the refund, or is the dude screwed?
 
I think she has to offer a refund. If she had offered some sort of insurance option, she'd be in the clear. But I'm not sure, I haven't been on eBay that long.
 
it doesnt matter if you offered insurance or had any kind of return policy. The question is did the person paid with paypal? If they did they can file a claim and get a refund.
 
i think you should refund as paypal will side with the buyer most of the time, if not all of the time. If it was broken then the fault does lay with the seller, Your Wife. I would ask for some kind of proof that it is broken like a picture. If it looks like it was broken during shipping then refund and mark this as a lost. Getting the jar back is up to you as what can you do with a broken jar if it is true.

You might want to try the UPS Store or Fedex next time because they have 100$ insurance and I believe that the retail places have an insurance that you can collect right there if it is broken. I really hope it did not cost a lot.

Once he comes back with the picture, offer to maybe go half and half, like a partial refund or something along those lines. Obviously it's virtually worthless now, so maybe he'd take a little $ back and try to fix it.
 
I agree, I would try for a partial refund first, but yes paypal would side with the buyer no problem on it should it go to a claim.
 
eBay/PayPal will completely side with them, as their policies indicate that it is solely the seller's responsibility to ensure that the item arrives in the promised condition; as its the seller packing and shipping it, they are liable for any damage occurring in transit or if it is lost in the mail.

It sucks and is why I generally insure anything $40+

Anything of value, include the insurance in the shipping costs.
Buyer still wins, but you can recoup your $, eventually.

I would also like most have said do some kind of deal like Total Price - Shipping cost. I think that is fair as the shipping is not going to you but a lost. I think that the guy would do that at the very less as he did contract you compared to just going to Paypal and getting his money back.

In other words, Try to get some partial refund.
