Ebay purchaase question...

I won an auction for a DS game on Ebay.

It's condition was listed as "Very Good" which means "Very Good: An item that is used but still in very good condition. No damage to the jewel case or item cover, no scuffs, scratches, cracks, or holes" "The video game instructions and box are included. The teeth of disk holder are undamaged. Minimal wear on the exterior of item." "See the seller’s listing for full details and description of any imperfections. "

The seller's listing description just said:

[Game]
for the Nintendo DS.
Item is used but is in excellent condition.


The item arrived today, and the game works and its in the original case with artwork, but there was no manual in the box.



This really irks me because the seller didn't note that, and by the description listed it should have included the manual.



Should I contact the seller and ask for some money back? Or file a claim to do the same?


I'm hesitant to even bring it up because the last time a seller forgot something, I ended up getting harassed via email outside of Ebay with some threats, and Ebay wouldn't do anything about it. This seller has my address so I don't want to rock the boat in case the seller is some kind of psychopath.
 
Just contact the seller about it. Might have been an honest mistake, but a lot of sellers are lazy and don't do a good job in the descriptions. Try to work it out for a discount or return if you're really unhappy.
 
Contact the seller. Be courteous about it. The thing is some sellers know better, and some are honestly in the dark about eBay auction policies. But, if you are missing the case or manual, you aren't really supposed to use anything but "acceptable" to list the item, even if the disc is MINT. I try to steer clear of people who don't mention whether it has the case or the book or not, etc., because they seem to be the ones missing those items.

I had this same problem with a Blu-Ray movie I bought (Clash of the Titans 2010), the seller listed it as like-new and never mentioned the fact that the DVD and Digital Copy were not included. I contacted the seller and told me, "I never said they were included" and had to bust out the ebay terminology. He did the right thing and sent me the remaining items and its not like I paid cheap either I believe it was $19 or so shipped. Since then I've backed off buying Blu's from ebay considering this is the trend at the moment.
 
Just throw this caution in as well.

"New" does not necessary mean "factory sealed" on ebay. If you are looking for a sealed game, make sure the description says so or contact the seller.

I got burned once years ago and received a resealed copy.

"Acceptable" is the default eBay condition if the seller doesn't actively change it. I don't like many of eBay's new policies, including requiring a "condition." This forces you to shoehorn your item into their pre-written conditions, and it is ripe for problems like the OP mentioned--especially because I'm sure the seller never read what eBay prints out since the seller is just making a choice from a pull down menu.

I know I do, the criteria they added to the conditions are not very good. Ever since I started, if I had a game in excellent condition with a case but no manual, I would list it as "very good". I can't really say I'm inclined to change this practice now either, partly because I always give very detailed descriptions anyways, and partly because I don't think long-time buyers have caught on to these changes either... I know when I'm speeding through listings on the 'bay, and I see a cart-only game listed as "acceptable" I'm not thinking "oh that just means it doesn't have a case", I'm thinking "this cart is probably split in half and might work 8 out of 10 times", to be honest if it wasn't for this thread I probably wouldn't have realized how greatly they changed the terms, and I'm sure many other buyers are in the same boat.

Of course, this is no excuse for bad listings; if you see something not mentioned or just a generally simple description, always be sure to write the seller and verify first, or else you'll get some sing-song "I was intentionally vague and now you're screwed" response from the jackass.
 
I sent the seller an email through ebay's message system that said:

Hello. I received the game yesterday and it works fine. In the listing's "Item Specifics" the condition was noted as "Very Good" which includes "The video game instructions and box are included." However, the instruction manual was not inside the game box. I was wondering if you happened to have the instruction manual and just forgot to include it? Thank you for your time.

I know its a little passive but I didn't want to aggravate the seller.

We'll see what the seller comes back with.
 
And the response:

It was shipped with everything I got when I bought it. So I don't know if it doesn't come with one or I got it with out one.


I possibly believe that because the game had NEW (but very old) stickers from GameStop on it - so someone at GameStop could have taken the manual out when they were gutting it or something. But it still doesn't change the fact it was listed as coming with the instructions whether or not the seller knew thats what he/she was listing it as.

Thoughts about what I should do next?
 
It was used and not sealed correct?

I don't get why that guy couldn't open the case and look.... How could he not know? he seems like the kind thats going to fight you to the end.
 
Well he knew there wasn't a manual, I assume, but he just didn't note it in the description then chose the Ebay description that includes shipment with a manual.

I can only assume the seller would play dumb and act like he or she didn't know that 99% of games - especially major console games - come with manuals (except for Ubisoft games as of late - but this isnt one of them).
 
I'd say get a few bucks knocked off as a partial refund at the very least. Though there are some differences of opinion on grading as eastshore4 mentioned, how hard is it to type that there's no manual included?

P.S. For the record I might list a clean cartridge as very good, but I would also say that it's Cartridge Only.
