Ebay well half.com screws seller in a way who sorta screwed me

Alright on July 2nd I bought a DVD from half.com and all was good I thought. No DVD a month later I email the seller, and told them that I had not received it yet. They took about 3 days to email me back. Then he said that he has been very busy with work and school. He said that he didn't ship out my item yet and that he would ship it priority mail. I email him 2 weeks later. I said that priority mail takes at most 5 days from coast to coast and I still have no DVD. He tells me to keep waiting and if I don't get it in a week email him. Finally about 1 week later it comes and it was shipped 1st class mail. DVD comes in the condition it should be new and sealed. However it took 1 month and 3 weeks or 2 months if you a rounding type. It shipped from New Jersey.

The main point of all of this is that about the 1 month and half point I figured the guy was scamming me. So I filed a dispute with half.com. I heard nothing from them. After I got the DVD I figured that I would cancel the dispute however I could find no way to do so. So I thought at least they would ask me more questions and I could tell them forget it but nothing.

I got the DVD around the late part of august. Today I get an email from half.com saying they are refunding my money from the transaction, So what to do? Do I keep the money to "teach" the seller a lesson or do I tell half.com to take back the money and wait the 3 months from them to reply?
 
You need to repay the seller. I believe you'd be committing mail fraud otherwise.

Just let him know it'll be 4-6 weeks until you can process it.

However how is this in a small way any different then from getting home and unbagging all of your groceries and seeing that they forgot to charge you for that brisket you bought.
 
Hmmm....that's tough. Since you (eventually) ended up with what you wanted, I'd say give the money back. But, that's just me. I know you had to wait, and the seller obviously shouldn't have taken that long, but I'd be the better person and just give the money back...
 
Unless Half.com comes back and asks for the money I say keep it. 2 months is crazy, funny how he had time to take your money but couldnt spare 10 minutes to go the post office or at least take 2 minutes to email you saying he was busy.

It took 25 days for me to get the book, because seller was "out of town."

I'd agree with that, but bump it up to 15% off the price and subtract the amount it would have taken to ship priority mail since he promised to send it that method but did not.
 
You probably didn't hear anything from half.com for awhile because they were awaiting the seller's response to your claim. When a period of time elapsed, they "closed the case" and refunded your money. Half.com probably did everything right here.

Regardless, karma does exist in this universe. Find a way to pay the seller back.

I agree with the karma thing sorta. However is it not my money then since he never responded to my half.com claim. If he would of responded I probably would have been able to cancel the claim. I am still debating I have heard good things from both sides. The best idea and probably the one I will go with is send him back the money subtract 20%. But I would like to hear more from CAG
 
I'm not going to say what's right or wrong, I really don't know what I would do, but I wouldn't even deal with a guy like this in the first place if I had read those user comments.
 
I'd say keep it, from those comments he gave out he just wants to get slapped.

If you didn't send the item for 25 days and said cause people have 'lives' then maybe he shouldn't even be selling.
 
I still really like the idea of deducting a minimal charge (10-20% like you said) and then shipping it back after a month - it would even the karma out :)
 
Give the guy his money back, and don't buy from him again. You got the DVD and it was as described. IMO the whole keep the money or send it 7 weeks later resolve is just lowering yourself to a level that I know you are far above. No one really knows the sellers true story and probably never will but we can all agree the he was being kinda of a jerk for whatever reason.

Since no one got physically or emotionally hurt in this situation, leave the guy negative feedback and move on. You are inevitably going to have to give the money back and the bullshit you'll have to deal with if you keep it just is'nt worth it.

I'm not sure but if that negative feedback was there before you bought from him then you are going to have to be a little more stringent with your risk assessment in the future
 
Agreed, you're obviously better than him, so don't stoop to his level, if you were not satisfied with the shipping, which you clearly shouldn't be, re-pay him the full price of the DVD minus shipping, but I wouldn't go any lower than that...
 
I had a similar situation happen not long ago when selling something to a guy in canada with half.com. Apparently you mail it to a distribution center who in turn mail it on to the canadian. This didn't happen as it was supposed to. I sent the game (a $4 ps2 game no less) to the address provided, and now this crazy ass chinese guy is sending me death threats because I didn't give him the game.

Also, when dealing on ebay and half, make sure to look out for people on the gulf coast. They probably won't be sending anything anytime soon.
 
Email him saying you can't cancel out your dispute, and to please contact you if half.com gives him any trouble about it.

If/when he emails you saying they took the money back, reply with "oh nuts- sorry- as soon as it gets back into my account, I'll re-pay you." Then wait like, 3 weeks.

Otherwise... I'd consider just keeping it. It he hasn't raised hell yet, it might be that half.com paid you out of pocket, instead of taking it from him. And somehow, I doubt they have a setup to for you to give that back. :D
 
This exact thing happened to be a couple years back. After receiving the item in question, I wrote the half.com department again to let them know. Again, this was a couple years ago, & it may have been a real PITA to deal with the case in question, so they just left it. Or they might have just refunded the seller. I was never in contact with either party regarding it.
