ECA Discussion Thread - WARNING: Some CAGs Who Cancelled Are Being Auto-Renewed

Wow this is back again eh? It's kind of sad most my points are all related to The ECA and their shenanigans. They still have fake and broken member benefits over there too. Sadly that issue fell by the wayside due to all their bigger screwups. One of the worst run "nonprofits" ever.
 
I also got the auto renewal email, but have yet to be charged. I think part of it as to do with the fact that I used a shopsafe account that is now no longer valid and the fact that after I canceled my account and turned off auto renewal, I never logged back in. If I'm charged, I'll go ahead and call my bank to dispute the charge.
 
I'm surprised no one filed a civil class lawsuit yet. I'm sure if you slap a lawsuit in their face, they'll rethink about charging you guys. This reminds me of when Ebay charged me and I've never used ebay before. >

I joined because I wanted to believe they'd do something, but they really haven't. They haven't taken a stand against DRM, they haven't done anything to really promote consumer rights at all. In fact, you can pretty much argue that they've been anti-consumer during this whole shitstorm.
 
Well I signed up July 5th, 2009. I was on the list that was sent out to mass cancel and got an email December 23rd, 2009 stating I was canceled.

I have attempted to login to see if I could, but it said I was not a user or not active.

I shouldn't have an issue though, I generated a card through Paypal for a one-time use.

Yeah. I paid the 15$ for my .edu e-mail in..july maybe? I didn't care about the free code either, other than the nightmare it caused(though I guess that ended up helping me too). I was planning on staying a member assuming either 1) They kept the amazon discount or got something else I could atleast try and use or 2) I could actively see them doing something, anything. It was hard to keep the faith after the end of last year and I sent in my notice with the cagbox too. Now it's just a freaking joke:roll:
 
So first day back to business.... how nice that this problem happened near the weekend.

I wouldn't imagine refunds will show up for 2 or 3 business days, usually takes a while.
 
This situation, once again, is beyond horrible. Even though I cancelled with the the rest of my CAG brothers (both on-line and through the mass mail package), I'm gonna be on the lookout and hope I don't get screwed once my membership comes up.

I hope none involved are suffering too much crap over this because if you are, perhaps damages for mental anguish could be added to the class-action lawsuit, if it is ever organized and filed. Life is complicated enough as it is to be worrying about unauthorized charges/fraudulent activity. Round 2 sure is heating up...gotta wait to see how this thing goes...

I'd like to know what they are doing to. They pretty much high fived Ubisoft because they're too afraid to actually take the industry on and lose what every clout they have with the industry which I think is laughable. This is, of course, assuming they even think Ubisoft DRM is bad news which... they've never actually come out and stated. What exactly are they protecting beyond their own existence at this point?

Perhaps you weren't aware of the original issue was that started this ECA mess to begin with... the part about charging people who don't want to and didn't agree to be charged. And where are we at at this point, oh yes, the ECA charging people who not only didn't want to be charged but supposedly had an agreement with the ECA that they would not be charged.

:roll: Come on, this kind of crap can be stressful. Maybe not the same to everyone, but having random charges being made on your credit card, outside your control is stressful.

True, but they were so quick to charge. Anyways, I figured we'd get some kind of contact, one of the unlucky ones should have gotten some kind of feedback from ECA or the billing company.

Just looking for statements from them. Would be interesting if they say anything.

Exactly. I mean, if all you have to worry about in life is how to get through the next chapter of Bioshock and your mom has tons of cheesy poofs waiting for you, it might not be a big deal.

But if you have real world worries, this, while not the end of the world, adds on to other stressful stuff at work and in your life. By itself, no big deal, but a pain in the ass. And the reason it pisses people off is that it's one thing you shouldn't have to worry about: a consumer rights company fucking the consumer.
 
This again? I have my account set not to be auto renewed, and my account expires in about two weeks. I wonder I'll end up getting charged again...
 
Wow...ECA back to being a villain, big surprise there:roll:. Can't say this is really all that unexpected, particularly after their cancellation shennanegans.

Sorry for everyone who has to go through bullshit with these clowns, YET AGAIN (especially those that never even got a chance to use the Amazon discount codes, stacked or not).

Once again I find myself EXTREMELY glad I never signed up for this...the 30% + off new releases from amazon would have been great, but as with everything in this world it seems there are consequences/headaches.

Good luck to all having to deal with this crap...
 
Guys, I got this from the ECA forums. This was an update from ECA to a person that posted that his credit card had been charged and that he had cancelled it through the system properly.

Another update:


The ECA took swift and comprehensive action last December when members requested that they be permitted to cancel the annual auto-renewal of their membership and/or their affiliation with the organization as a whole, should they desire. In an effort to accommodate those requests, we built out a new module which would enable that functionality and then manually deleted the database references to those users. But we were, and are, required by law to maintain a copy of membership lists for a certain period of time. As a result, the second reference - which we believed isolated from the member list - was used by the system to automatically renew a limited number of former members when their renewal date occurred. We were advised of the error by complaints and commentary made on third-party forum sites not related to the ECA on Friday afternoon and are currently correcting the programming mistake. The effected users' credit cards will, of course, be refunded the incorrectly debited funds and they have our sincerest apologies for any inconvenience. If anyone has any further questions regarding their account, please use the ECA feedback form here: http://www.theeca.com/feed_back

Sounds like ECA new setup still doesn't work properly. Hopefully they will have this rectified by Sept.(my renewal period). I might just change the credit card number I have now so they can't even bill it. What a headache. I would definitely check your credit card if your at that one year renewal time.

ECA is just a bad word to mention on this forum. I can't believe this company is still in business. There bait and switch tactics were so blatant and this from a company that fights for consumer rights. Yeah right!!!! I mean I come on this forum trying to find new deals and I seem to always be reading about ECA as the highlight of the day.
 
So I guess its safe to say those who theyre aware of that wanted to be cancelled, are cleared from there database and wont be charged?

yeah i cancelled my membership via mail months ago but i realized today that i still get their newsletter. wtf...they better not renew me
 
The thing I want to know is if people need to contact them about getting charges or if they'll refund EVERYONE who canceled, regardless if they call in to complain or not. I'm guessing it will be up to us to check our statements, as we should anyway, but otherwise if we miss that charge for any reason the ECA will gladly take our money erroneously and possibly the next year as well...until we finally catch on.
 
For those wondering why the ECA didn't take a stronger stance against Ubisoft and their DRM shit, Hal Halpin founded the Interactive Entertainment Merchants Association, which has since merged into the Entertainment Merchants Association. Who is the Entertainment Merchants Association? They represent 1,000 companies throughout the United States, Canada, and other nations. Its members operate more than 20,000 retail outlets in the U.S. that sell and/or rent DVDs and computer and console video games. Membership comprises the full spectrum of retailers (from single-store specialists to multi-line mass merchants), distributors, the home video divisions of major and independent motion picture studios, video game publishers, and other related businesses that constitute and support the home entertainment industry.

In short, that group represents the people who the consumers need some protection from.

Why would Hal's "consumer protection" type organization go head to head with the people with all the $$$$$ who made Hal who he is? Hal has no problem spouting his mouth off against the government, but he won't take on the people who gave him money in the past.

Accidents happen, but given ECA's history of anti-consumer activities, it's also easy to understand how others could instantly become suspicious over the current situation.

It is also of grave concern that the ECA outright lied regarding the deletion of billing information, and also concerning that all that information could easily be compromised. It doesn't get much more anti-consumer than that.

That depends on your definition of worked.

It worked in that everyone got their accounts cancelled ... i.e. unable to log in.

it didn't work in that everyone is getting billed for renewing.

I recently (on April 23) canceled my membership via their website. I turned off auto-renew and then out-right canceled the membership even though it expires in September. It stated that all financial information would be deleted.

I received the membership termination email confirmation. I can no longer log in to ECA like the rest of you.

Today I just received my first daily ECA Newsletter in my email since I canceled. This is fucking annoying. I'm not even going to wait until September to "wait and see". I'm going to write them via email and in it a stern warning should I be charged in September. I do NOT want anymore emails or anything to do with them....AT ALL.

I do NOT care to hear excuses any longer. I do NOT care about mistakes. The only mistake I see is that this organization still is in existence. I DO want them to leave me alone. No more more emails....and most definitely...NO MORE CHARGES.

What part of this can the ECA not fucking understand?

So here is a pretty civil email I sent them. I never threaten anyone with legal action unless I mean it. Supposedly they are "fixing" the issues right now for ex-members that were charged without any authorization. Awesome. That means that by September all this crap should be a non-issue.

But somehow I don't believe them as the current issue should have never taken place. And I believe people will keep getting screwed and cheated with their fraud regardless of their excuses.

So without further ado, my simple email to the ECA...



Hello,

I'm just going to get to the point and be as forthcoming as I possibly can.

I canceled my membership via your website on April 23, 2010. I turned off the auto-renew function and outright canceled my membership even though it didn't expire until September 2010.

During the membership termination process it was stated in writing that all financial information would be deleted. After completion I received a confirmation email finalizing the termination of my membership.

If this is true, why am I still receiving ECA newsletters? I say this because I am well aware of MANY ex-subscribers who terminated their memberships and not only still received newsletters but were also charged again without ANY authorization.

Consider this letter as a preemptive notice that I do NOT and will NOT authorize any future charges. As stated in writing during the cancellation process, all my financial information was to be discarded.

If any unauthorized charges are made to my account come September 2010, know that it will be dealt with legally and quite swiftly.

It is my hope that this organization abides to its own contracts in a precise and ethical manner.

I sure as hell am serious - are you?! Listen, I try my very best to control my spending because I live on a fixed income and make it month to month, or more like week to week. If I get an extra 20 dollar charge on my account, that could affect my ability to put food on the table for a couple of days which is a big freakin' deal. I don't really deal with cash anymore so I rely mostly on my debit card for all my spending. The balance stays relatively low and I watch it like a hawk so I don't have to worry about any overdraft fees which could put me in the hole even deeper.

So, anyway, if a 20 dollar charge were to surprise me, just the amount of time to contest it (or even take the time to cancel card, wait for new one) is an inconvenience I don't really need right now when I live in the real world and have other crap to be worrying about. I'm not hitting you up for money so I don't see why you're so bothered that I take it very seriously when someone tries to take the little that I have without good reason. I'm sick and tired of the ECA for what they did to us the first time (I was unfortunately a full-paying member) and won't let them bend us over just like that. If you can lose the money, get bent, and still have a smile on your face - more power to you.
 
I'm sad to say this isn't a huge shock. The ECA seems to run by a bunch of monkeys. I was happy to see them add a turn off auto-renew feature, but based on all the incompetence they showed in the past, I was afraid they would've messed this up too.

I just canceled, mostly to make sure that they don't renew me in September when I expire.
Right on the confirmation page it says:

*Terminating your active membership in the association will remove the financial information on file, and will cancel all rights and services available to you as a member otherwise, but will not remove historical and contact information which ECA is required by law to preserve. "

I'll have to set a reminder to check my CC statement in September to make sure they didn't charge me for a renewal.

Canceled my membership before it renews in July. I wonder how many comments they get about Amazon discounts in their "Why are you canceling your membership?" section.

Alright, I just managed to turn off the Auto Renew and cancel my membership. Does anyone know how to cancel the newsletters as well aside from e-mailing them directly and asking to be removed? I'm seeing that some people are still receiving them (and I've no interest in still getting them). I don't see anything on their site either.

You can find a section in their newsletter emails to unsubscribe to them. Most subscription email systems are set up that way. I did this and have not received another newsletter email since.

Why would they issue a refund check instead of via the credit card company? Much easier to just dispute the charge. That also is a way to f the ECA. ANd they deserved to be f'ed in the a.
