It pretty much looks like you may only sell digitally distributed goods if you are the creator of it now.

Read it properly, it doesnt say if u are the creator it says u have to own it meaning it can be pirated.

Wrong.

"The seller must be the owner of the underlying intellectual property, or authorized to distribute it by the intellectual property owner"

That states that you need to own the IP, which is owned by Lionhead or whoever. You don't own the IP, nor the digital download. You also have no proof of authorization to sell it from the owner of the IP. Therefore, you can't sell that item on eBay.
