I'm selling it for a friend. She says it's new (at least that's what she was told). I'll ask for a receipt

I have the receipt but it doesn't say explicitly that it's new, all I can say is that we were told it's new. And it definitely seems that way (still in its casing and wrapped)
 
well you are saying it was recieved as a replacement for a broken ipod touch, explain, if you brought it to apple because it was broken or you broke it, and they fixed it by giving you another one, its a refurb. i just think you should clarify what you are selling either a new item or a refurb because there is a big difference between both
 
it was received as a replacement for a broken ipod touch. As I said, we were told it's new. The clerk at the store was nice enough to replace the broken one free of charge with a new ipod touch
