Gamertags? (and backstory)

Alright : I'm going to post the short end of the question here - and expound later (for those of you who don't like a long story).

Can you auction your gamertag (along with your marketplace purchases) on ebay or sites like that? Any caveats?


Back story:

I think my brother is finally done with MS.

Here is the sequence of events:

1. Buys a 360.
2. Disc drive gear failure (dvd door wont open.)
3. He ships it off.
4. He buys a 2nd 360 and decides to keep the other as a backup for us just in case one breaks.
5. He recieves 1st 360 (cd prob) - tested it.. and put it back in the box as a backup.
6. (a few months later - his 2nd 360 RROD so he goes to the backup (the repaired disc slot one and it some unknown problem despited working last time was in the box)
7. Is furious but ships both back to MS - to be fixed.)
8. The both get back.. tests them - puts one up as a backup - and plays the other..
9. His primary RRODed today.. and the backup isn't working...

He's pissed.. and thinking of selling off all of his MS stuff and getting a ps3. What's really screwy is that we have the same setup.. same tv - same fans - everything - except mine is a pre-launch 360 and has never had a problem (so far).

From what I understand - he has quite a bit of marketplace content.. (all robot chicken - all of the science universe episodes - some southpark - and some arcade games.. and probably other stuff as well.. )

He can't very well transfer the license and since can't he seem to get a good 360 - he really seems SOL..

So..

Can he sell his gamertag with his 360 and list the content.. or does copyright and licensing prevent this? If it does.. can he sell it directly to a person - or perhaps transfer it to me.. (so that the content isn't at least lost.. )

I'm really at a loss on this one.. I'm fairly good at communicating with Corp entities and so far haven't attempted to speak on his behalf and honestly - I'm dreading it. and I'm wondering if I even should or if it can even bear fruit. I'm sure there are literally thousands of people that share his story and frustration and are looking for some kind of "bone". We all get those occasional messages from people on our friends list that wont be on because of RROD or some other problem.. I just have the feeling that there is already a standard operating procedure for dealing with situations exactly like his and that he is going to get some "automated" corporate spiel.

The thought of this frustrates me. I really want to fix this situation. My brother and I play on line together quite often and if he gets a ps3 - It'll kind of put a damper on that. So.. any suggestions on how to fix this situation would be greatly appreciated..

I tried calling support : I spoke with a nice guy named : Herbert who said that the policy right now on 2nd and 3rd repairs is free repair and expedited shipping. He did say he'd have to pay to repair the other broken one. I told him I'd call him back tomorrow with the serial numbers and to speak to a supervisor about it..

I then asked to be transferred to the Live team. The guy that answered the phone seemed nice enough.. I had to repeat the whole thing.. he wouldn't just give me an answer.. and then.. he just hung up on me.. I looked down and saw that it was 12 cst - which is closing time at 1 am.

I kinda got the feeling that he wanted to keep me talking so that he could just hang up on me at closing time. I don't know if the system autohangups or if he did it intentionally but it was pretty crappy considering I was the perfect example of politeness... It kind of shocked me.. I definitely wasn't expecting it.

So.. I guess I'll call tomorrow and try to reach the live guys to see what they say. I'd like to know if the system just shut down.. or if the guy hung up on me... I'll be sure to share what they say...

I think it's against the TOS/EULA.
If it is eBay will take down an auction for it as well. I tried to sell my four digit steamID and almost got banned. Your best bet is to sell it on our own.
 
Gamertags are only supposed to be played by one person. It seems like hes had some bad luck. Luckly my 360 hasn't messed up yet.
 
the only way to get someone to buy your gamertag is to see them in person. You would have to supervise their change of password. Does your brother still have microsoft points? that would be a different story.

I feel bad for your brother. I got my 360 last year, April 2007, and it still has not broken down by wear and tear or RRoD. I guess i got lucky.

I'd think the gamertag falls under 'personal account' type thing, like in an MMORPG, and that selling it is against the ToS, and even sharing the password (and thus the account) would also be against the ToS. If his tag moved to your house and it sometimes logged in from your house, they probably wouldn't do anything, if they even discovered it.
The EULA for paid content includes phrasing like "You may use this content on the device it was originally downloaded to, and may not resell or transfer it", so regarding that content, he might be out of luck.
Regarding the above quoted paragraph: From a call center perspective, that's just wrong. I can't believe MS would have their call center routing programmed that poorly. It's one thing to get disconnected at a shift change or closing time when you're in queue, that can happen due to poor end of shift routing, but to actively disconnect a call in progress means something's wrong. I can't imagine any call center actually programming "at midnight, hang up all active calls" in their system. One agent who really wants to go home, yeah, I can see that, folks have done all sorts of things at my call center (and been disciplined for it of course).
