I ordered a neo geo pocket game from a seller on ebay, the item was listed as ***NEW***

I got the game yesterday, cart only, in the plastic case. I emailed the seller asking where my ***NEW*** game was and got the response:

"I am not sure what is going on here but I always, always have shipped the neo
geos in there plastic cases and have advertised them in their plastic case as
well as showing a picture of the item as cartridge only so as not to confuse
what I am trying to sell. I have not ever had a problem with this before and I
have sold hundreds in this condition without issue. If there was not a plastic
case with this, that is amazing to me since i have never shipped without it so I
am at a loss of words. "

So am i to blame that I thought an item listed as ***NEW*** should come in the box with instructions, or should I have assumed that I would get what was in the picture? (this item was listed multiple times and all items had the same picture)

I voiced my concerns to the seller and got this response:

"I guess everyone has their own definition of new but I purchased these directly
from SNK and Capcom. But I do not have the instructions. Thanks"

Negitive feedback or try to contact him again?
 
was there a picture in the auction?

did he mention box and instructions?

I can see your point, but I think you have some responsibility in this . . .

"New" can be abused
 
If there was a picture of it, then you should have asked questions before bidding. I feel sorry for you, and I think it was deceptive (like 90% of auctions), but you really should have known better. That's my two cents. But it seems like we hear these types of complaints on here all the time, and they could have usually been prevented with a simple e-mail pre-bid. Sorry about the bad deal though. Maybe just chalk it up as a learning experience. (I doubt your out too much money on an NGCP game...)

Just go to your ebay account, find the page that the item is on where you won the auction, and copy the site address. Post it on here and then we can all access it. :)

It sounds like you got misled, but then again, I'm only hearing one side of the story.
 
No offense to the OP here but did you honestly even look at the auction before you bought it. The picture clearly shows just the cart and im not sure what a new/sealed copy of neo geo games look like but im sure it comes in some kind of box. The description also clearly states what you are getting so I don't see where the deception is on the seller's part.

I only buy my games brand new and have never had a problem because i check out the picture, usually a stock photo which doesn't help, then read the description throughly and if i have any doubts I always ask a question.
 
The seller doesn't deserve a negative, as it was not entirely his fault. How about a neutral, with a description of your problem?

Learn this lesson for the future: NEVER bid on anything without asking questions first, unless the description is EXTREMELY explicit about what the item is, and the title, description, and pictures (if applicable) all concur with each other. Otherwise, you're just asking for frustration.

It is hard to tell what you are getting from reading that auction page. Like everyone else is saying, an email could have cleared up the confusion. I wouldn't have bid on that auction the way it is.

I do know that SNK was releasing these games in plastic cases when they were clearing them out and games are certainly harder to find boxed. I'm sure you got an unplayed "new" game, but I don't blame you for wanting more. I find it interesting that the seller will take returns if they are unopened. How will he know if you got a game in a plastic case?

I guess he is right in saying everyone has their own definition of "new". That is so true, especially on eBay.

On a comment he replyed to on a neutral.

I would go with a NEG for this. The item was listed as NEW and in the auction it is described as BRAND NEW. Sorry but cart only is not new no matter how he tries to explain it. He should get a NEG for having misleading info in his auction.
 
Technically it is new. I think it was mentioned a few posts up that when SNK was getting rid of their Neo Geo games, they sold all of their games in bulk to wholesalers in that condition, just the cartridge in a case. Some later released games like Fasieli (spelling?) are only available in that condition (for the US version).

Even NCSX is selling Neo Geo Pocket games cartridge only as new for the same reason:

I'd have to say no neg or neutral. Like YoshiFan1 said, some Neo Geo games were re-released recently sold only in the plastic case, with no box or instructions. This is probably one of them.
 
It is new to you. I would leave a neutral. It seems just a touch bit deceptive.

One of my first times buying something on ebay like 3 years ago or so. I was looking for a Jax and Daxter it was BIN for 8.00 I was like alright. So I buy it get free shipping. Thinking everything is awesome. Get it in the mail its a damned DEMO. yea I paid 8.00 bucks for a demo. because the seller said game all though the normal description and in shipping description was the only time he said demo. It was something like I will ship this demo quickly. they left me a positive I left a neg because i felt they were purposely being deceptive.
 
If you feel a neg is warranted leave that. That picture is stock-photoish looking to me plus really crappy quality - kind of an odd combination, so I can see the confusion. But you really should have asked before bidding.

He has quite a few withdrawn FB, so I'd expect you'll get negged back and he'll ask to do that. Be sure you mention in the FB that a refund under his terms is not possible due to you having to foot both shipping charges.

He has also left retaliatory neg feedback in response to getting neutral (Not every time, I checked two and he did it once) So I would not leave a neutral for this seller.

A large portion of the CAGers that have problems with a seller get fed back some line about how 'I've sold dozens/hundreds of items just like this and have never had a complaint!' That is so unprofessional, and would really piss me off.
 
No you are not getting ripped off. I base that opinion on 1) you paid 6.35 for it. 2) the guy has over 10000 trades and only 3 negative feedbacks. 3) it may in fact be new as in never played. 4) the picture shows only game. 5) the negatives or neutral feedbacks he receives are from ebay newbies with 5 or less transactions. 6) the previous number includes you.


After a while once you get experience in buying this won't be a problem.

Wait a minute you consider 3 mutually withdrawn feedbacks 'quite a few' thats .0002% of all feedback. what is considered not much?
 
The craziest thing was the shipping! $5 for 1st class? How much was the postage on the package you received? I would guess 73 cents? Now THAT's profit.

Out of all of the neg FB he's received, a good portion has been withdrawn. This tells me he always leaves retaliatory FB and requests it be mutually withdrawn.

Yes he has received very few neg FB, but looking at jus that subset there is a high % of mutually withdrawn compared to other sellers I've looked at.
 
This is bull.

If he had admitted fault or that it was a mistake - fine. But he put the word "new" to draw people in to look at his auction. There's no way of getting around that.

I had the exact same situation with a seller three weeks ago and even made an almost identical post to this one. I told that seller the only way she could avoid negative feedback was to take the word "New" out of all of her auctions unless they were truly sealed in the boxes.

Two days later, all auctions changed to "like new" or nothing at all...

I've been fed that line before, wubb, for a guy I bought a game from that was damaged in shipment. When I bitched about the crappy packaging (IMHO, of course we have this discussion all the time about packaging), he fed me the same line. :roll: And it did piss me off, since it was so condescending.
 
Are you going to play the game or did you want a sealed box copy to collect? If your going to play it i would be happy with what you got. The auction isn't really deceptive but theres no reason he couldn't add one line to the auction to clarify what the buyer is getting.
 
As a seller, it was being deceptive. That's NOT a stock ebay photo, I can tell you that. When we have items that are new but unsealed or something, we mention it. Right now, we've got an Ace Combat 5 bundle that was a display item, but never played, so the box was opened. We stated that in the auction, just in case the buyer has a problem with the box being opened. Same if it's new but the manual is missing, or the case artwork is torn or some such thing.

While with used games people should expect some wear and tear, this says new, no matter how they were released to the distributor.

As far as a neg retaliation, you can always respond to it in the feedback area that it was retalitory and move on. One neg will not kill you.
 
It is a NEW game, its just not COMPLETE. Sorry, the blame would is on you for not looking at the pictures, reading the description, and for not asking any questions.
