Go thru paypal dispute or ebay dispute process?

So, I purchased a "new" ps3 game that came repackaged with shrink wrap that you use for food/sandwiches and defective - refused to load on both my ps3 and my friends ps3. Disc, manual, box looks new but most ps3 games don't really get scratched.

The seller is refusing to take back the item without a 20% restocking fee that was tucked away in the bottom of the auction in significantly smaller font than the rest of the auction.

Its been a long time since I had to open a dispute on paypal/ebay but which one should I go thru? Ebay's process or paypals? I already contacted the seller and he is adamant on a 20% restocking fee to take the item back and has stopped replying when I stated I will not pay restocking for a defective re-wrapped item sold as new.

Any help will be greatly appreciated.
 
I've always went through Paypal. You could probably do either though as they are pretty much one in the same. Just open it as item not as described. Keep in mind you might be required to pay to ship it back yourself.
 
File eBay buyers claim for product significantly not as described. He will have to offer a refund or he will lose the case.
 
Just noticed the seller was NARU'ed today and paypal sent an email to ship back for a full refund without restocking fees.
