Help!! What do I do???

A few days ago I bought Jet Force Gemini sealed off of ebay. This guy had perfect feedback and simply said in the description that it was sealed in the box. Well, I got it today and I opened it to find out that it has obviously been resealed. The wrapper has a hole in it, on the inside it doesn't even have the manual, the game is not in that little bag, there is a fuckin label on top of the game that's probably from a blockbuster, the "Designed for N64 Rumble Pak" symbol is a STICKER, the game itself is dirty, and the box itself is faded. I sent the guy an e-mail asking for a refund and explaining why. I have little feedback as is and I'm afraid that if I leave negative feedback, he'll do the same and I'll be ruined for ebay. What else do I do? Should I leave negative feedback? Should I report to ebay?

You definitely deserve a refund in this situation, and you're right to worry about him turning around and leaving a negative feedback. eBay does have a feature that lets you see what kind of feedback this guy leaves for other people, so you can see if he regularly does that. In this case, the best thing to do is probably to just eat your loss and keep the crappy copy, or sell it to someone who doesn't care and then get the one you want. Otherwise, Paypal may be of some help if you used it to pay.
 
Report it to ebay! Report it to paypal. You may get you money back and be able to keep the item. Next probily not good to leave negitive, as you tend to get them back even if you did nothing wrong. Wait till they leave feedback then zap em with the neg or don't leave at all. sucks that way. You should have to leave feedback as the seller right after they pay. then sellers couldn't do that anymore.

The description does mention that it is USED, so I'm not sure what you are complaining about. The description didn't say the items you are complaining about didn't exist. Always ask questions if you are ever concerned before bidding.
 
Yup, the description says used and he confuses the issue by saying it's sealed. Yes, it's sealed. Yes, it's used. It's shady, but it's also as described. So I don't know what recourse you have.
 
You were tricked but that doesnt mean what he did is against any rules.

This is why I list items as NEW and FACTORY SEALED.

Sealed does NOT mean NEW.

Sorry but your best option is just to leave neg feedback and keep the game..so what you paid $16 for it...
 
yeah, you got suckered. it does say USED, but i don't blame you for not realizing this since you're new to Ebay. I've learned that if something says NEW and UNOPENED, that means something entirely different from SEALED. that sucks, and i hate that this seems to be a growing trend for games, cds, and DVDs...
 
You can report it to ebay, however there is not a real violation there. Unfortuately you made the mistake of believing that sealed means New/unplayed/mint. Its a common mistake, Im not trying to insult you. However technically it was sealed, and he did list the condition as used. I would ask the user for a partial refund. Because you will loose shipping the item back, and he will most likely not pay for return shipping. Or you can just resell the item and cut your looses and learn a valuable lession.



People also buy items that are quoted as MIB mint in box. But they get confused believing the package will be mint too.
 
Being a newbie on ebay sucks. We get tricked so easily. The worst part of it is that I paid close to $20 with shipping for a used rental when I could have gotten a used jet force gemini at eb for only $5 shipped.
 
Haha he even says "If the item arrives not as described, please don't give me negative feedback. Email me, and you will get a refund or exchange." Wait 90 days from the end of the auction and give him a negative so he can't retaliate.
 
Lol, i was watching this item about to bid on it to, same exact one. when i was looking at it, it was at $3 and shipping $3.50 so it would only cost $6.50. Luckly you bid way over me, LMAO.
 
i say you don't leave negative feedback. instead, just be cool about the situation and explain it to him. leaving a negative feedback without even allowing the seller to answer your question is totally lame. if he ends up being a dick to you, that's a different story, but chances are he may try to work something out, in which case you would be a dick for leaving negative feedback.

I hate to say it but the listing does say USED, does not say 'complete' or 'with manual'. He is deceptive by using the sealed in box description, but it's obviously a re-sealed used copy. Anytime I sell a sealed item I list it as such and disclaim any responsibility for the contents as they cannot be verified without breaking the seal. A responsible seller would state in the description and title that it is a USED copy. I think it's deceitful that this seller did not.

At least you didn't get gouged on shipping, and you'll know how to read auctions more carefullly next time. CAVEAT EMPTOR.

This is a perfect example of a reason to have a STICKY Ebay Blacklist thread in the auction forum.

Then his negative will just become one of many worthless negatives from one of the many zero feedback accounts out there. If you took the hit form the negative then built a lot of good feedback, then your negative will be a better warning to new buyers.

I agree you should take this and learn from it. Somehow I think even the seller knew he should of listed it was a resealed game, and should of said "..item sold as is..". If he knew it was used he should of open the reseled plastic and actually looked inside. What if whoever sealed it and sold it to him put a rock inside >
