How to file complaint against criminal

I requested Gamefly to remove my information including personal information, address and credit card since I'm never willing to use them again, but they denied it.

"We apologize, but our system does not allow for the removal of records. This would leave us without a clear record of your account and transactions. Rest assured that we use the highest level of credit card encryption and we do not share our customers' personal information."

I don't have money for a lawsuit so I would like to at least get helped from the law, I don't know.
I just don't know where to start.

Anyone knows how?
 
Not much you can do. They do need to keep a record of you as a customer. You can try to escalate to a manager, or as far up as you can but not much will get done. If you're not happy about this, you better not join netflix.

Storing credit card information, everything that's needed to use it online, when I request to be removed?
Plus, I don't owe them anything.
 
yeah i don't know how illegal that is, i know most major retailers have that information in their databases. i worked at circuit city and you could search for customer orders using the credit card # (if you had it). but you couldn't actually pull the number from the system (atleast at the store level, maybe at some database somewhere in the country you could). i know that best buy (and probably other stores) have a similar system, so i'm guessing that's what they have as well.
 
They probably don't actually have your credit card number stored anywhere. They probably have a one-way hash of your CC info that they can send to the credit card processor each month, but nobody can get your info out of that hash.

What does their membership agreement say when you sign up? They probably have a clause about records retention.
 
Most retailers are required to keep customer information for at least three years in case someone comes back and says that their card was stolen and used. It's designed to protect against customers using fraudulent cards and whatnot, milking the system for what they can, and vanishing without a trace.

I would hope so. I'm not a lawyer, but I would assume there is nothing illegal at all about this. You willing gave them your information. They didn't steal it. They didn't get it from another party. Just because you don't want to use their service right now does not negate the fact that you did use it, and they need to keep records of your business with them.

When I read the thread title, I assumed it was about an eBay scammer or something. I would not categorized GameFly as "criminals."
 
I don't know what happened, but all he told me is nothing special that I could have done it by myself also.

There was a case about a company got shut down shutdown due to them storing user's information and not willing to remove it at people's request. I don't know much about the law and that is the reason I asked for a help here and there from my lawyer friend, but I just thought it wasn't right especially with the case above.

If it's not illegal then so be it. They removed the information I would like to be so therefore I'm darn cool with it now.

Totally. Because we all have the time and money to hire a lawyer to parse through the 20 pages of fine print that accompanies any purchase made on the web and then dispute the paragraphs that we find are too vague or objectionable.

Why would I even care in the first place. As the CEO of Facebook points out, noone really wanted any privacy anyway. Corporations are just helping you to become less anonymous.
 
So, a company, as they are legally bound to, provide you with the terms and conditions, and because you're too lazy to read them, that's their fault? Right...

Considering Google, Facebook, Netflix, and lolGamefly are still around, I'd like to know more about this unnamed company that got shutdown shutdown.
 
LOL Paranoia and stupidity. The two best things to have in any combination(for hilarity to ensue) on the internet.

ZOMG They're keeping my info, they're criminals. No. They're not. You willingly gave out your information to become a member and like others said they must have legal reasons to want to keep the info in their database for a set period of time.
 
Unless you represent the state you won't be filing a criminal suit against anyone! You want to make a civil tort claim... but I'm not sure what. Intentional infliction of emotional distress? Invasion of privacy? I doubt you could win on any claim.
 
I went to a store last night and bought an item for a predetermined amount of money. How do I get them the death penalty?

Like I said I believed this was not right.
Plus, I read terms and conditions, but if that gives either side, usually the consumer, a strong disadvantage it will be neglected. So that's what I thought could happen.

Now I get it this is something normal and I was wrong. I admit it, sorry.
But did you really have to be all asses to help someone who had a wrong belief to give him a right picture how it worked?

I guess we have too many knows-everything-right people in CAG. Wonderful.
 
Ask a stupid question, get a sarcastic answer. That's the way it works all over the internet. If you wanted to really know if you had any 'rights' to get your information deleted, then you should have taken the time to read the terms and conditions from Gamefly's site. If you didn't understand any of it, you should have printed them out and taken them to your 'lawyer friend'.

Why look for the answers themselves when they can be lazy(seems to be a trend with the newbies in recent months on CAG)and keep asking the same question until someone just relents and answers it for them.:roll:
