How to get/fix controller?

I'm posting this here. Don't move it. I posted the exact same question in the proper thread and no one answered it.

Now, I have a black controller that came with my Elite that I purchased on Dec 4th. I noticed when I was playing a game, the RB button now is becoming unresponsive (won't trigger a response in a game). I've contacted Microsoft, who was even less helpful than usual. I have no idea what the warranty is on included controllers, and I can't get an answer out of them as to if they would fix it.

Now, I can try breaking the torx locks and opening up, fixing, and being on my merry way. But I have no idea if it's fixable, and if it's not, I'm screwed. I could try calling into MS, but chances are I'll be on hold for an hour and not be able to understand what the rep is saying.

Or, the unethical option of buying a new one and doing a switch. I'd rather not do this, but I feel like I'm being forced into this choice because I cannot get the answers I need.

You would think all bundled accessories would have the same length warranty as the system, but the website is less than helpful. EDIT- I see that the accessories are only 90 days. Question still applies.
 
Just so you know, an auto parts store carries the star bit screwdrivers so you dont need to break anything. I had to open my controller up once.

Yeah, it will only register if you hit the button on the very top part, towards the charge port. Unfortunately, the most natural thing to do is hit it on the very outside.
 
When I had an issue with a controller on my 360, I called into Xbox support and had someone who spoke English set up a RMA for me. I shipped my controller into them, and ended up with a new retail-packed controller. Total time, less than a week, including shipping on both sides.

I just noticed that with my new controller after I stop moving in CoD4 I still ever so slightly move one way or another in an apparently random fashion. Noticed it 31 days after purchase at Gamerush. Boo.
 
I wonder if I could buy broken 360 controllers off ebay and send them into MS for new ones, thus equating to cheap controllers...

Hmm... indeed. I was thinking about this when I read shrike's post. Someone needs to try this out.
