sold my copy the bundled version via 50 shipped on half.com. Would this be illegal since it has the no reserve, no exchange in the words in the back?

nope, according to the first-sale doctrine once you purchase something it's yours to resell. link

I think the thing on the back of the case is to prevent stores from breaking up the bundle and selling the components of the bundle individually. however, I don't think that this would be illegal either, since the merchant is in fact purchasing the product from the manufacturer to resell at a profit.

I've sold games that were bundled with my 360 before with no problems. I usually put a note in the listing that they are buying the bundled version just so they don't freak when they get it. But no worries you are just fine!!

I assume it isn't illegal, but if a contract was signed between the store and publisher, (which is rather likely) and they release the game improperly, it could get the store in trouble.

In any case, you don't need to worry.

It wouldn't be illegal per say, but whoever breaches the contract could face legal ramifications and penalties.

Gamestop has sold THOUSANDS of copies of Motorstorm with that printed on the back. Would Sony be more likely to sue you, or a company that made billions of dollars last year.

yup it's yours to do whatever you want with it. You bought it, you own it. I sold my copy of ATV 2 to gamestop, came with my ps2 bundle. They didn't care, I'm sure that copy will be sold to other customers.

Like the other posters allude to; it is labeled as such because it is considered a promo item for the retail store. Most gaming systems only generate a few dollars of profit for the retailer, they make their money on the accessories and games. So that printing makes sure that the retailer doesn't separate the game and sell it as pure profit, Sony is taking the hit by including the game for free but it will off-set the loss by moving more units.

I've always kind of wondered about this. It probably makes the most sense that the "Not for Resale" label is for retailers because these items usually do not contain a UPC either. I see used promotional items all the time in both game stores and used record stores and I always feel the need to chuckle at the irony.

You can do whatever you want with it. However, it may be advisable to indicate it's a NFR copy when you put it up for sale. Some collectors may freak out when they realize it's a NFR copy or a promo copy that has its UPC punched out.

*Looks at Sony's legal actions through RIAA*

I agree with you but...

Admit it, you all sold this without feeling guilty about disobeying the box and cart's rules.

It's ok if they sell them used because some people sold it to them that way. It wouldn't be ok if they were selling new copies that they got from the publishers...

But I'm not selling my pillows.
