I couldn't find the K-Mart deal thread for 360's so I made a new topic in anger.

Looks like the stupid fucks at K-Mart decided to charge me and send out my 360 as of today to furfill their backorders WITHOUT calling me! It's been two months since I ordered from K-Mart and they have decided to go through sending me a core 360 via Fedex without even calling me about this situation. I was very angry, of course, and decided to give their customer line a call and they told me to refuse the package. I am pretty brainless when it comes to processes like this, so I just ignore the slips fedex leaves at the door? What if they decide to play jerk and leave the package in the open? To top it off I don't know of many K-Marts around me, so returning it via B&M will be a hassle. I suppose I could sell the 360 off to a friend but I don't know if he's interested at the moment.

Just a warning to those who ordered 360's awhile back. Because before they told me my order was canceled and I would not receive a 360. Now they decided to send me the package after all this time. wtf?
 
Checked my order status from the 23rd of November and still says backordered...(supposedly cancelled by K-Mart, according to Kmart.com when I called).

However, my order from Dec. 20th shipped soon after...

Both were platinums.
 
Watch the tracking, figure out when its going to get there. If youre not going to be home, put a sign or something up stating that you refuse the package. I had to do that with UPS one time.
 
If you have a cancel slip from an e-mail, I'd say it'sK-Mart's screw up. You should be able to dispute the charge on your CCif you can prove they cancelled on you. Sounds like a free 360 to me. And I wouldn't think you should feel bad about doing it. That is illegal for them to do to you.
 
Funny, I was just thinking of starting a thread about this. I ordered on 11/23 and it was never officially cancelled but people were talking about Kmart actually coming through on them. Then about 12/15 I got a call from Kmart customer service and I stupidly said "yes" that I still wanted one . . . but then never heard another word about it.

I just called Kmart and they say I have no open orders!?!?!?!?!?!?!?!?!?!?!?!?!?!?!

No thats the problem, I don't have a cancel slip via e-mail. They just told me over the phone "Due to excessive demand your order was canceled", awhile back. I don't see the charge on my CC yet but I'm pretty sure it will get charged when It's here. I am not happy with K-Mart to say the least. I feel backstabbed. I plan on calling fedex and telling them I'm not accepting the package because of this.
 
IF you dont see a charge, or a hold on your card it might be worth holding onto. They might have screwed up even more and forgot your CC number ;p
 
Well just called fedex and they are returning the package back to K-Mart.

I was in the status of: Package data transmitted to FedEx . So maybe it was easier to cancel that way.

Well that would have been a nice dream, that won't happen now though. I really wanted this order canceled. Stupid k-mart and their two month shipping delays... worst then overstock ;)
 
I just got the same email from Kmart. Interestingly, I DO have a cancellation confirmation email from them from roughly a month ago. I suppose I'll call FedEx tomorrow and have them RTS while it's still en route. I don't have a charge or hold, but it's the weekend, so I'd expect a nasty surprise on Monday or Tuesday (since Monday is a holiday).
 
isnt there some law that says unsolicited mailings are yours to keep if you didn't order them?
Since it was cancelled, that might count? For a $400 item, I would look into it =]
 
Bad luck! Mine didn't ship via FedEx; it's shipping via that terrible APX company. My CC company indicates that no authorization or charge is presently pending, and the tracking number doesn't work yet. Oh well - my CC indicated that in the worst case, if they did charge and ship and I did an RTS upon delivery, I would get reimbursed for everything, including shipping.

Couldn't find anything online re: the unsolicited package issue.
 
Keep us up to date. I called Fedex and had the package returned. I don't see a charge on my CC either, it was a CC/Debit card since they didn't take AMEX. I hope everything turns out ok.
 
I also have the same situation, having a 360 sent but no charge or hold on the credit card... we'll see what happens.
 
I called Kmart after noticing that the order date in the shipping email was yesterday as opposed to my original order date - seemed pretty clear that they had re-initiated the order in order to re-authorize my CC. I still have no 'pending charge' listed, but these things tend to wait until the next business day to show up.

After I said what I was calling about (a cancelled item being shipped), they correctly guessed that it was an xbox - must be a number of calls coming in. They credited me for the shipping charge (indicating that an actual charge for the full amount must be pending), and told me to return the system to my local Kmart for a full refund. I still don't show an authorization or charge, so if one doesn't show up by Tuesday AM, I may hold off on returning the system until it does.
 
I'm in the same boat as some of you. I was told to refuse the item and I would get a complete refund. The thing that is pissing me off is that unlike most, my order never got cancelled on its own. I personally called and requested the order to be cancelled and I was assured that it was done, when I call the rep even says that I called and cancelled on Dec. 18th. Now, I never received a cancellation email and didn't even figure to check until I received a shipment email yesterday. I called and argued with 3 different "supervisors" ,they don't know shit, and all said nothing could be done just refuse it. One said to dispute it with my CC company and well I don't plan on being out $300 for what could possibly be a month for Kmart to get it's shit together so I plan on doing that. What happens when you dispute a charge with your CC company? How long does the process take?

I do kind of want to wait and see if they charge me or not?
 
You usually have to file a written request for a dispute (some might allow you to call) and then once approved, you get a credit back on the next statement.
 
The full charge just showed up on my electronic CC statement, with a transaction date of 1/13 :(. Looks like I'll be heading to Kmart after it arrives. A hassle. Also, watch out - the CSR on the phone indicated that their lazy shipping department has been known to just slap a sticker on the outside of the standard store box and send. With something as hot as the 360, this obviously presents problems. Apparently someone else had their console replaced with a brick en route. I'm not sure if we would have any recourse if this occurred.

P.S. Kmart is ass.

I ordered the Xbox 360 CORE back then on the kmart site, and today when I opened the box, there was the Xbox 360 in the white Premium box. So I check my statement and my receipt... They charged me for a core and sent me a premium.

I figure someone would screw up, but at least it was in my favor.

(It's going up on ebay.)

I'd go for that. If that happens to me I'd be ok by it.
 
Edit: NM I'm an idiot. The package has to reach the shipping station before it can be sent back, even though It's traveling from another state.
 
This is why I voted Kmart as worst online retailer. I am actively cheering for all of you to not get charged or get upgraded. I hope Kmart loses a bunch of moneya nd someone gets fired

Yes, if DeBeers aciddentally sends you $3million dollars worth of diamonds instead of the local jeweler... well the "Finders-Keepers Act of 1967" comes into play, and they are yours to keep.

Oh wait.. no, there is no such absurd law.

Theres a difference between you receiving something addressed to you and meant for you, and getting something meant for someone else.

If you get something in the mail you did not order, you are not obligated to pay for it - that is Federal Law.

"The receipt of any unsolicited goods shall be considered an unconditional gift to the recipient who may use or dispose of it in any way he/she sees fit without any obligation on his part to the sender."

This probably isnt the best example, since people initially ordered the 360 - but i just said it was something to look into if your order was cancelled.
 
I just received my system today. I too ordered a core, but was sent a preminum. Shit, I'll take it. $328 for a $400 MSRP item that no store has in stock without an expensive bundle.

I think I'm gonna keep it.

I would suggest that we not talk too much about the "free" upgrade some of us might have gotten in case they may catch wind of this and upcharge it to your credit card, if they can even do that.

They can try but it would be illegal. He authorized a charge of $328, no more, no less. If they went back and charged more it would basically be theft.
 
did any of the people who got "upgrades" get their system delivered by APX? I am really hoping for that but I still haven't received it and it's coming through APX. For note, their tracking system sucks.

Well got my package today despite them telling me it was canceled yada yada. Let's just say I got a upgrade, and instead of sending it back I plan on keeping it. Anyone elses box say "Do not sell till 11/22/2005" ? That seems like it's a first shipment of 360s which hopefully means the system isn't more likely to be defective :(

Worst of al lthe package was right infront of my door! Anyone could have stolen it as I live in a apartment, but it was untouched amazingly.

Also I was charged for the core, so is it illegal for Kmart to charge me $100 later for the premium? Either way my friend has agreed to pay the extra charge if Kmart tries it, hopefully this doesn't happen. But now i'm pretty happy about this situation because my friend is gonna have a 360 tonight.

Mines was the same way, they just left it at the door. Makes me wonder if this is a first shipment batch.

Well I got mine today and I was happy to find I got upgraded as well!!! Thank you to whoever it was that mentioned the mistake because I was just going to refuse the package.
 
glad to hear peoples x360s are being shipped.

Mine is being shipped too but by APX, who is APX? Their trackin sucks. been like a few days since they sent it and still no status on their site.

anyone ordered on cheapest rate and got delivered via fedex?
