The $37.99 listing looks legitimate. If it turns out to be fake, bring it up with the seller and if they give you any trouble, do an A-Z report with Amazon.

I wouldn't buy from him if I were you... he only has 4 feedback, 2 of them say their item was DOA, 1 says he didn't test the item before leaving feedback, and the other didn't specify at all.

I only deal with sellers that have over 1,000 feedback so usually that helps with weeding out possible scams.

if i were you op unless youre in a rush to get a new ds3 wait for the next dell/amazon deal. theyve both had deals on diff occasions where you could get a ds3 for that price or less. just wait and it will happen again.
