Need help with a bad Ebay auction!

I recently won a Xbox 360 off Ebay. I got it in today hooked it up and it has the RROD. Not only that but it didnt come with a controller like it was supposed to. Needless to say the seller is pretty shady and will not give me a refund until I ship back to him. I dont trust him at all and demanded that he refund first before I esculate this to Ebay and paypal.

So basically Im just asking for some advice and suggestions to get this resolved so I can get my refund back asap.
 
You should definitely escalate this to Ebay and Paypal if he doesn't want to be reasonable in giving you a refund promptly before receiving it back. They usually put more faith in to buyers rather than sellers now, regardless of feedback.

So with how the majority of similar cases like this end up, you should have no problem at all getting your money back before having to ship it back. Good luck, though! Sucks you ended up getting a lemon from a shady dealer.

Submitted a claim just now. Also should I leave disgusting feedback for him now or should I wait until all is resolved?
 
Ebay usually takes care of that part for you so unless they aren't able to resolve the claim themselves and they suggest that you contact PayPal then you shouldn't have to.
 
id file with paypal immediately along with ebay, although do not list it as " nto as described " they get put in the back of the que. as soon as your file is sent they will freeze the paypal account so he cannot duck and run. do it right away, show him you mean business then let him know you will drop the case upon refund. if at the stage in the complaint the resolution center requires you send the items back, ( which most do before issuing you a refund ) send it back with tracking and add the cost of shipping to the claim for reimbursement.

leave feedback after the transaction is done but before 30 days is up. also post their ebay id and stuff here too so future CAGGERS do not run into them.

good luck and if you need any help lemme know, i been selling on ebay for about 7 years on and off so have gone through my fair share of douchebags, scammers, and asshats.. so far none have bested me even though it took insane amounts of leg and paperwork on my end it eventually works out.
 
You will need to return the 360 before you get a refund. Make sure that you include tracking.

Other than that, filing with both PayPal and ebay is the best way to go. It sounds like the seller isn't adverse to giving a refund, but just wants the system back first. Filing before you send it back will help mitigate refund issues if any arrive.

Sadly, you will most likely not receive a refund for your return shipping.
 
Man, I feel you about the 360. I had to send back my 360 3 times before the third model I received back from them finally quit working as well. Had to dish out the extra money afterwards to get a brand new 360 after going through all of that. Hopefully with the new motherboard I wont have to send this one in as well.
 
Do you have a link to the auction you won? Did the description of the item say it was brand new or excellent condition and as a buyer did you do your part to ask questions before bidding? Not saying it is your fault but there are protocols for bidding in auctions.
 
Make sure you include tracking when you return it. But dont use signature confirmation as the seller might refuse to sign
