Possible Scam by eBay Seller (quickly resolved)

I just received a package in the mail from a seller I bought something from about a week ago. I won Galactic Attack for the Saturn and payed w/ paypal. I got a great deal on this, only spending $1.00 for the game + $4.00 for shipping. Inside the package was the case of Galactic Attack, but inside the case I found Datona USA: Championship Circuit Edition. I've emailed the seller about this but haven't heard back from him/her yet.

If the seller can't send the game I won or refuses a refund would paypal and/or eBay side with me? It's slightly possible that this is just a mix-up but I'm not sure how this could happen. Someone selling games would at least check inside and make sure something was there before sending it out, in this case realizing the wrong game was there. Daytona USA is obviously not Galactic Attack. :whistle2:?

I would give the seller a few more days... it might have just been one big mix up.

I know I took some games to trade in, and inside one of the cases was a different game completely, and I could have sworn I checked them before I left, so it does happen.

I say give it two or three more days, and then take action.

What's the feedback like? This could go a long way to figuring out the situation.
 
Give the seller a few days, if there's still no reply then send a sternly worded e-mail giving an ultimatum ("if you don't respond within xx hours then I will report you to eBay / contact your local law enforcement authorities / etc.").

PayPal won't side with you because he sent you *something*. I've heard of this guy who sent out empty boxes, but because he used Delivery Confirmation and sent those #s to PayPal, PayPal sided with the scammer and said that he had proof of shipping and everyone who got scammed got double F'ed by PayPal until they got their credit card company involved.
 
Both eBay and Paypal do not give a shit about their customers. I dealt with them for months for a charge of $25 and they basically blew me off. Assholes.
 
Well, this was much easier than I thought it might be. The seller has already emailed me, explained that he just didn't look in the case and stated that he's sending me a cash refund today.

Maybe 20 minutes after I emailed him:

"sorry i got mixed up but send me your address and you will get a full refund sorry it just i never looked inside but anyway you will get a full refund thanks"

Then 1 minute later:

"mailing you $6 cash today"

I only paid $5. :lol:
I asked if he wanted me to send the game back to him and I got this response:

"keep it but don't send it back itm is up to you if you want me leave you good feedback thanks"

He wants me to keep it but not send it back. :lol:

That's good of him to be totally reasonable. I guess he doesn't have the game then?

I can see myself doing something like that. I have this really bad habit of putting discs into cases they don't belong in (like taking A out of the console, taking B out of case and into console, and A into B's case).

I'm guessing it was an honest mistake. I bought a game from ebworld.com once and got the wrong game. I got Knights of the Old Republic (xbox) in a Second Sight (ps2) box. Tell me how that happens.

Unfortunately, he doesn't. At least I can probably get a cheaper disc-only copy at some point. The game doesn't show up much on eBay though.
 
that happen to me.

i won Final Fantasy Tactics 13.50 free shipping original and i got FF8 GH instead but i email the hoe and got my game and i aint sending back ff8 :D
