On the 13th I ordered quake 4 from a seller. After waiting a week I sent him an email, just asking if it was shipped, no rush. He said it was "returned in the mail". Likely story. He said he would ship it out that day (the 20th). I finally got it on the 29th and it was postmarked the 27th. It was also sent in a mailbox with stamps...like he couldnt find the time for that 2 weeks ago. Anyway I figured that was fine as long as the product was ok. It was listed as "Great condition" it looks like a retarded infant with sandpaper fingers owned it. It seems to have gotten stuck in the dvd tray so he must have yanked it out. I had a friend buff it and the deeper scratches still remain. It plays ok but seems to have longer load times than my friends (my 360 has no issues). I am also worried that these scratches will cause the game to fail at a certain point since I only played the first level so far.

Anyway I emailed the guy with a test. I told him I didnt get the game yet and he replied that it was sent back to him again and my adress must be wrong...I verified it with him the last time and never had trouble before. But the thing is...he told me he will ship it again on monday so hes obviously lying to me. He lied about shipping it....even when I have it in my house! And he lied about the condition...should I just file a non recieved item? I would like to just return it,,,but I have a feeling this guy will just take it and not refund my money.
 
If you're not satisfied with the quality, by all means, file a complaint. I wouldn't file a non-received item, because you did in fact receive it. File a complaint about the condition.

I hope you paid with a credit card, you can always challenge the charge if you're not satisfied.
 
that totally sucks....thats the think i am most worried about when buying things online, the hardest thing to earn is trust

i wonder he would send you another one? lol
