To bryankasch,

I have sent you many PMs to which you have only responded once saying that you received the item I sent. I sent your Gamefan magazine on 2-15, and you then got the item a couple of days later. I sent you a PM a few days after your 1st PM letting you know that I have still not received your $5 check/money order, and that that was alright. It has now been over a month and half since you have last tried to contact me to resolve this issue. I have been more than patient and have sent you a handful of PMs ending with the same result, NO RESPONSE! I sincerely hope everything is alright with you and this is not like that one case of fraud, but it turned out that the trader got in a car accident and lost her eye; yet, I highly doubt that something that horrible is wrong with you since you posted on here on 3-19. You need to respond to this, and please if any other CAG sees him posting, let him know that dman is waiting. Thank you.

I can't remember her name, but the other trader made a scam report about her and it turns out she got into a car accident and lost one of her eyes.
 
User got in a car accident and was badly hurt. That was during her trade with The_Continental.

dman, did you check bryankasch's feedback before dealing with him/her? I know zewone has left a bad feedback for him.

I had started a deal with bryankasch, for a copy of Castlevania:HoD (a couple of months ago during one of the Kmart BL sales), and after he didn't PM me for a solid week with a response about sending payment, I told him that I was moving on to someone else.

So, I can least concur in a small degree about him not responding to PM's.
 
I've ran into a few people like that, which just do what I did. Give them a one week warning that if they don't send the payment, that you're going to file Mail Fraud on them. Usually they will send the payment, although 1 or 2 them I did have to file charges on.

Usually the longer it is you wait, the less chance that you'll ever get anything from them.

Yeah, I checked his feedback, but I don't remember his name having a # sign next to it. Our trade was initiated way back in the beginning of February so he might not have had it back then. As for who sent 1st, we were sending at the same time.

BTW, supermariomelee, how do you actually file charges on someone for not trading with you on a websie?

Well normally it works best when they claim to send something but don't, like when you get a fake DC# off them.
 
Where do I go to file charges? He claimed that his wife sent out the money order and that he was going to ask her to make sure she did, and that was the 1st and last time I heard from him, which was about a month and 1/2 ago.

Could 1 of the mods please make this thread sticky, or whatever you guys do with something like this. Thanks.
 
If you sent your item to him via USPS, I think you can still file mail fraud charges. But I'm not sure on that.

Now that you mention that I did send via USPS, but the envelope even with the magazine wasn't thick enough to put a delivery confirmation, at least that's what the post office lady told me. So the only thing I have right now, is the PM he sent me stating that he received my magazine. DOH!
 
Using DC or not shouldn't matter as far as being able to file a mail fraud charge. (I think) Although I'm sure it won't help with any investigation they might do. I'd call your local Post Office or the national USPS help line, explain the situation, and ask if this is something you could file a mail fraud charge over or not.

And a parcel has to be at least 3/4" thick to use DC for 1st class. No thickness requirement for Priority, not sure about Media Mail, though I would bet there is no thickness requirement for that either.

The clerks at my PO would give me a hard time every now and then about the games I mailed in a bubble mailer (they were 3/4" thick...) Even got a ruler and measured them once. Sheesh.

I have no clue why they would make a thickness requirement for DC on 1st class mail. I guess they just like to be able to insist you pay for Priority :)

Yeah, I looked it up myself after the first time I was hassled over this at the PO, but didn't feel like digging up a link :) I generally would just insist that the package is 3/4" thick and they go ahead and mail it. I've mailed a few disc only (or discs in sleeves) and have used cardboard to artificially thicken it out to 3/4" or just mailed them Media Mail.

The one time the lady measured she put the ruler up to the crimp in the middle of the mailer (so that would be about half the thickness of the thickest part...) and smugly commented that it wasn't 3/4" thick. I just said you have to measure over from the top to get the 'thickest point' measurement. (It was kind of hard to believe someone actually lacked that much common sense...) and she agreed to mail them with DC. I'm not sure if I convinced her or if she just decided it wasn't worth the fight. Either way was fine with me.

As far as trading going bad, that is considered under it. I had someone last year with 50+ feedback on another site rip me off when I sent him a sealed copy of LOZ: Collector's Edition, when he was supposed to sent me Halo & $15. Of course, when he stopped emailing me with the last email saying "I'll send it out on saturday" and got nothing, I filed mail fraud. It took about 1 month to sort everything out, which I guess around the same time he ripped 3 other people off, with mine included of a total $450. Which all I had to do was give them printed copies of the emails, the delivery confirmation slip & the receipt, cause they were going to charge him in one case with all the complaints gathered up. I later found out that he served 2 months in jail for that, which I never did get the game back.

Just shows you what you have to go through for getting screwed, but at least you'll get some revenge.
 
supermariomelee got it up right before I did. I was reading the mail fraud site and it said that they look at the number of complaints against the individual. Plus, I only have his PMs as proof right now.
 
dman1869, I had problems with this guy too. He was supposed to send a money order and never did! He was supposed to send first so I didn't lose my games. He ignored my PMs and post. I didn't lose anything other than potential offers from others so it wasn't too bad.
 
Well bryan finally sent the money order, just got it today. Only about 2 months later, but he sent it. I think the suggestion from supermariomelee might have helped.
