U.S. Army major is challenging his deployment to Afghanistan by charging that President Obama was not born in the United States and was therefore never eligible to be president, the Ledger-Enquirer reports.

The suit by Maj. Stefan Frederick Cook, a reservist living in Florida, was filed in U.S. District Court in Georgia last week.

The Columbus, Ga., newspaper notes that Obama was born in Hawaii in 1961, two years after it became a state.

Cook’s California-based lawyer, Orly Taitz, seeks a temporary restraining order and status as a conscientious objector for his client.

In a 20-page document filed with the court, Cook states he “would be acting in violation of international law by engaging in military actions outside the United States under this President’s command. ... simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties.”

Cook was ordered to active duty on June 9 and would go to Fort Benning, Ga., before deploying overseas.

Yesterday we told you about a U.S. Army reservist from Florida who has filed a suit in federal court challenging his deployment to Afghanistan by arguing that President Obama was not born in the United States and was therefore never eligible to be president and commander-in-chief.

Now the Columbus, Ga., Ledger-Enquirer, which broke the story, quotes Army officials as saying that deployment orders for U.S. Army Major Stefan Frederick Cook have been revoked. Cook originally was to report to MacDill Air Force Base today for mobilization to active duty.

The newspaper quotes Army public affairs officer Lt. Col. Maria Quon as saying that Cook had volunteered in May to go to Afghanistan and that reservists who volunteer for active duty can ask for a revocation up until the day they are set to deploy.

Quon said Cook had not asked for such a revocation, but would not elaborate on why the orders were pulled, citing privacy rules. Neither Cook nor his lawyer was available for comment, the paper reports.

The newspaper says a hearing is scheduled in federal court on Thursday regarding Cook's initial request challenging his deployment..

Obama was born in Hawaii in 1961.

he volunteered for deployment, then challenged the deployment in court, despite the fact that he could've just said "i dont wanna go"... so pretty much sounds like the only reason he volunteered to go was so that he could be in the newspaper

I thought his father was Kenyan (i.e. not a US citizen).

Anyways...I find it odd that they backed down so quickly on this (at least by knowledge it was quick).

well the whole thing is stupid. but my point in posting this is that the army is handling this just at moronically, thus feeding the conspiracy nuts. if you read the article that quote is from Quon goes on to say Cook hasnt asked formally asked for the order to be revoked. so why revoke the orders then? ship his dumb ass over there.

She added that there is an administrative process to request revocation of orders. As of this afternoon, Cook had not asked for his orders to be revoked, Quon said. She could not say why the soldier's orders were pulled today by 3 p.m. CDT.

"Because of the Privacy Act I couldn't go into it," Quon said.

It's feeding people who just want to come to the conclusion that they want to - that Obama is not a citizen. You post two quotes in the OP that explain the context perfectly (he did not win his challenge, but got yanked by the military in a way he did not want or request), fail to acknowledge that chasm, and, instead, refer to this as a "win" in your title.

You're framing it in an incorrect way, feeding those kinda of fuckers who want to believe this stuff. You're not doing a good job of pointing out the absurdity of it when you've taken it upon yourself to inform us of it.

The top brass can't possibly send someone over that did this. There is no way on god's earth this guy isn't going to be a symbol for snubbing the civilian oversight of the military. And hell, that's assuming he wouldn't overtly speak out against the president while in uniform (and who's willing to suggest he wouldn't?), which is bad for everyone in the military.

We all had conversations in the military about what dumbasses Clinton and Bush were (I was in during both), but this is waaaaaaaaaaay past that. He's not even a joe or some low level non-commissioned sergeant. This guy's a friggin major. He will at least be the executive office for a battalion, and may even be directly in charge of hundreds of soldiers. Our conversations happened at 2 in the morning with people of near equal rank and we sure as shit didn't talk about it with high ranking officers. I would NEVER have talked shit around anyone higher than an O-2, and probably not even then. This guy is an O-4. The stink coming off this guy would be a major distraction. Thinking your boss's boss's boss's boss is a brutal idiot is one thing. Knowing it's this guy would be crazy.

His ass should be stomped out of the service. He intentionally created a situation in which he could inject politics into his service and is directly challenging civilian leadership.

The low level guys that challenged Bush got stomped. So should he.

No where in the US Constitution does it say your parents have to be natural born to be eligible for the Presidency. Obama was born in the United States in 1961. Even if he was born in 1958 (before Hawaii became a state), he would still be eligible because Hawaii was a United States territory from 1896 to 1958.

That being said, his mother is still a natural born citizen and since he was born in Hawaii, he is a natural born citizen.

Since we're on the subject, where do you think Obama was born? Do you think he was smuggled from Kenya in a broad conspiracy plot by the Kenyans so they can take over our government? I'd believe that if Obama signed a trillion dollar free money program for the Kenyan government but we haven't heard one peep about them so far.

It's normal to question the birthplace of the sitting President of the United States? This isn't about his policies or the job he's doing. This is just another attempt of the right to make person of color seem foreign and thus less suitable for higher office.

Since you seem to believe that he's not a natural born citizen, give us some evidence on your side that says he was born in Kenya or some other foreign country. Don't give us the old abscence of evidence is proof of a some vast conspiracy bullshit.

Yeah, you shouldn't attack a President because they supposedly weren't born here (and you have no real facts to back up that idea), you should instead like at what they have done as president.
 
I'm OK with disagreeing with a President's policies. It's your right as an American. I was a huge Bush hater but I never claimed he was a Saudi spy implanted by the Arabs to facilitate 9/11. I never thought he was so beholden to oil money that he would prostitute this country.

It's these subtle jabs at Obama's lineage that shows me that racism is still alive and well in America. Let's throw his middle name out there until people think he's really an Arab. I love how constitutionality about his citizenship is so important now. 8 years ago the constitution didn't mean squat because Bush stole the presidency from Gore. Hmmmm, those 8 years of Bush hating must have been a counter-conspiracy against Whitey,.....

Anyhoo the onus isn't on me but Hawaiian state official confirmed that Obama was born in Hawaii and all documentation and information matches, these are things that have been common knowledge for months but I guess it hasn't yet made it to Free Republic. There are even newspaper birth announcements, long story short you are relying on a ginormous conspiracy theory and possibly time travel.
