I just looked on Craigslist for an Xbox 360, and some guy was selling his for $300 because he needed Christmas money. I immiedietly called him and asked him if it was still available. He said no, but his friend had one that he was selling for $325, then he added his friend stole it from Microsoft or something and he didn't know if I would want it or not. My first thoughts were, oh, I don't want something that is stolen, but for $325? I am leaning more towards not buying it, but I really really want one. What would you guys do?

Don't. If the person you sell it to on ebay gets busted you know for a fact that he's gonna spit your name out. Then you'll get busted for either being the one whom stole it or receiving stolen property. I say don't do it. It's also not right morally.

Buy it and take it to Best Buy the 18th or whenever they are doing that 2nd shipment thing. Someone will pay cash for so they dont have to wait. You could easily sell it for $450-475 if you just wanna get rid of it and not try to hold out for more. Plus you'd get cash and no way for them to track you down. Come up with a story about selling it to pay for your nieces Xmas because their house burnt down. People were leaving Meijers and Walmart and driving to Best Buy and offering to sell us their systems. One woman offered a guy $600 at midnight but he didn't take it.
Of course test it b4 you buy it if it's used and borrow one of those power converter things so you can have a lil tv in your car to show that it works. It'd be super easy to sell that way.

Well it is stolen, I can't believe there is a question about giving someone money for stealing something. It is easy to be ethical when the decisions are easy, but here is a case where to be principled will try you.
Now, practically speaking it is highly unlikely this person stole it from Microsoft directly. What is more likely is he stole it from someone he knows or his work. Then there is the fact that he wants to sell it cheap via Craigslist. Anyone with a few brain cells realizes people want these bad so why would someone sell (albeit hot ) merchandise below value when there is a huge demand? There are a lot of possibilities, none of them good. And technically, knowingly purchasing stolen merchandise is a crime. Of course the chance one would get caught in this isntance is astromically low, but it underscores the point that is wrong to support thievery. Hope that helps.
