The roommate situation

Ok, so I thought this was hilarious at first, but it seems a lot weirder now. I have two other roommates in an apartment at college. I've known one of them for a long time, and the other I didn't know before living with him. Let's call him "Tucker". "Tucker" is 20. We recently found out that he has started dating someone online that he met on Myspace. She lives in California. He talks to her on the phone all the time. We thought this was reason alone for us to make fun of his internet girlfriend.

But even more recently we found out that she IS 15 YEARS OLD. A five year difference, and her being significantly underage. "Tucker" doesn't seem to think this is a big deal and he talked about flying out to California from NC so he can GO TO HER SWEET SIXTEEN in Feb. He talked about going back out there for Spring Break as well.

I keep imagining FBI agents busting in to arrest "Tucker" for solicitation from a minor or something.

Thanks for the feedback. I'll advise him again about not taking that trip. He's annoying, but I don't wanna see him on the news jeez. That would be classic though
 
Your friend "Tucker" is gonna be in for a surprise when a bunch of FBI agents pick him up. Seriously, he's screwing himself. Even if the girl's parents dont care, MySpace always cooperates with the police in any situation like this.
 
As long as he's not asking for sex he'll be ok. But you really should encourage him to find someone local, and legal, before the FBI shows up and takes your PC as "evidence" as well. :lol:
 
It's messed up. If he's not talking about sexing her it might not technically be illegal, but yeah really messed up. You could get the phone number and call the girl's parents to let them know the guy she's always talking with is 20.

I'd try to get away from that creep as soon as possible.
 
California in particular is EXTREMELY strict about their consent laws. Some states have certain actions legal at certain ages, or within a few years of age between the participants is ok. But California is, if you are not 18, you will not be doing anything even remotely sexual with anyone.

Just curious, where in north carolina. I teach at a college in NC, and I have young kids and you can never be too careful.
 
He said he's not thinking about sex, but c'mon. He apparently talked to her dad online for about 2 hours and he said he didn't care about him being older, but the mom seems to have a problem with it.
 
Man, I hope, "Tucker," isn't a CAG. We don't need that notoriety when the feds take his computer. I can just see some righteous politician trying to destroy CAG.

It doesn't matter. There's phone records/logs and messages proving that they're in contact with each other. Regardless of what is said, thats enough info for the feds to do something. It doesn't necessarily mean he'll go to jail, but it gets them the right to search. Internet laws about this are getting stricter.

At my school, they offer counseling session/classes about issues in high school life, and one of the one's I went to was about online predators. She could also face charges for luring him there, too.

Since its a federal offense (over state lines) its federal laws, which is 18. I dont have a link though. Sorry if I just crushed your ambitions :lol:

Section 2423:

(b) Travel With Intent To Engage in Illicit Sexual Conduct. - A
person who travels in interstate commerce or travels into the
United States, or a United States citizen or an alien admitted for
permanent residence in the United States who travels in foreign
commerce, for the purpose of engaging in any illicit sexual conduct
with another person shall be fined under this title or imprisoned
not more than 30 years, or both.

(f) Definition. - As used in this section, the term "illicit
sexual conduct" means (1) a sexual act (as defined in section 2246)
with a person under 18 years of age that would be in violation of
chapter 109A if the sexual act occurred in the special maritime and
territorial jurisdiction of the United States; or (2) any

How could the content of the convos be irrelevant? Are you saying it's illegal for a 20 year old to have contact with anyone underage on the net/phone no matter what the nature of that contact?

In this specific situation I'd be surprised if the guy hasn't discussed sex at all with the girl, so it's probably moot.

No, but if they find out they're on the phone for hours a night, thats enough evidence to get a warrant, trace calls, track emails, etc. After that, they start looking for anything sexual in content. It only takes one concerned parent.
 
Tucker is headed for trouble.

Well, at least he'll be able to hear Chris Hansen read his MySpace transcripts before they send him to prison.

Even though I've met some cool students these past few years, I would NEVER, EVER give them my AIM/YIM ID's or myspace address nor cell phone number. Email is ok as long as its just how are you / all is well/ good for you/congrads but that's how far it will go. I keep a copy of those emails just in case. Some students have asked for my IM ID but I avoid giving it to them. Last year some of my students asked me if I have a myspace account infront of my supervisor and I said yes and that I use to locate former classmates for my hs reunion(which was true)... This would very bad on me if I were to have out side relations espically now that I am in the school system.
