This was at least applicable for the EBGames store in Castle Rock, CO. Odd thing is, when the associate who was helping me there did a price check, it came up as $49.99 -- but at the end of my transaction, it came up as 39.99, like a sale price. He was guessing it was some kind of sale price on top of the price reduction, as (of course) there were several still there.
[I don't know if this helps any, but I also happened to be picking up my preorder for PWAA Justice for All, and I picked up 3 used PS2 games there too. Would that have influenced it any, where you buy X type of games and get discount Y? Or was it just 39.99 on its own, or maybe only in that store? I'm not seeing that price offered online, either.]
