Update for what to do if ripped off! My system came in the mail today!

My system came in! Havnt tested it yet(memory card the guy shipped with the system doesnt fit in the slim....)but it came and all the games are in great condition....FFXII Collectors Edition doesnt even have a scratch on the tin!
 
Do you initiate contact with the seller or does he keep you informed? The flow of communication is important. Since he's a new seller, he could be a little slow and you'll have to give him a chance. Also, if he sent media (though $10 for media would have to be extremely heavy!) or parcel it could take weeks since third class is slower this time of year.

It's also the holidays, so personal and family issues do arise and if you get it, you can leave your thoughts in your positive or neutral feedback. On the other hand, since it is the holiday season, scammers also rear their heads so since you paid with CC Paypal, you can always raise a dispute via Paypal. If Paypal drags their feet you can also file for a reversal of charge with your CC.

Iv been trying to be very patient and havnt threatened him or anything. I won the bid Tuesday night last week and payed. I contacted him Thursday when I hadnt heard anything from him about shipping and he contacted me Saturday saying he tried to send it out that very day but reached UPS after it closed. I said no problem and he told me he would send it out. Monday I talked to him again and he said first thing Tuesday or Wensday he was going to get it out and would send me a tracking number. I havnt heard anything back from him so I just messaged him again and simply said hey you said you were going to contact me tuesday or wensday with a number and I never heard from you.

So again iv been patient and kept the line of contact open. Hopefully this is just someone not experienced with ebay and dragging their feet. Nice to hear you say that I was right that paypal or the CC company do offer reimbursements.
 
If it goes another few days without shipping, I would look into filing a paypal dispute or dispute the charge on your CC. 2 weeks+ is plenty of time to ship any item. But then again, I'm not too trusting of 0 feedback sellers since I've been ripped off before.

Iv never bid with a 0 feedback before...but I also am a sucker for a good deal to the point that sometimes even if I think things through I go against what my gut and knowledge tells me. Iv never done it before but this time the little voice saying "WoW a PS2 slim with 5 good RPGs for $85 and no ones bidding, its probally just because he has no feedback too" beat the voice saying "he has no feedback its a risk".
 
1. Contact the seller. You've done that, so that's good.

2. File a dispute withe PayPal. How long you wait to do that is up to you. If you're gut tells you he's not fucking you, you might give him a little over a week. I wouldn't wait much longer and it sounds like you aren't going to. If he e-mails you to ask why you filed a dispute just say you are getting nervous that it's been over a week with no shipment and all he has to do is ship the item.

3. File with your credit card if you don't get the package and paypal can't get your money back for you. Just make sure you don't wait too long to initiate the dispute but I think nearly all CCs give you 30 days with most giving a good bit more than that. Caveat here is I've heard some CCs don't accept charge backs on paypal payments.

Don't bother with eBay for a refund. I'm pretty sure they have a very high deductible on their free buyer protection thing which makes it next to worthless. I'd still file a dispute with eBay if it comes to that, but don't expect to get a refund from there.
 
Everyone here is giving you great advice, however, if it comes down to initiating a complaint, start with the merchant bank who issued your credit card.

Your chargeback rights are nearly absolute in a situation like this, and it saves you the step of dealing with Paypal directly.
 
First thing I would do now that you have waited LONG enough is get on Ebay and request his personal information. Then call the phone # that he has listed and talk to him directly usually this will work. If not file a claim though PayPal saying you haven't recieved the item.
 
and once he files claim thru paypal he sends empty box and wins claim. Then you get to fight with paypal since your not allowed to file 2 claims on the same item. fun fun fun!

I ment file a claim through PAYPAL for a refund due to the fact he didn't receive the ITEM......
 
Just get his personal info and call him.

I had to do that for a 10.99 blu ray a while back. Jerk wouldnt send it.

Got his info and called him up. He was so shocked he sent it express the next day :)
 
Yeah I'd look into filing with Paypal. I think they cover up to a certain amount. Ebay may not cover you at all if he had 0 feedback but I think paypal will (not sure on this).

I bought an xbox360 for like $300+ a while ago, kid never shipped it, so I googled him, found his address, called his mom, and got myself a refund.

Might want to review how paypal works. They will give seller 2 options. Refund the money or send the item. if he chooses to send the item all they need is a delivery confirmation number and they will close the claim in favor of the seller.

Sorry man just tring to help the OP with his problem and I've taken those steps and they worked for me.

Why are you trying to prove me wrong? Have you done what this seller has done before since you know how to "work the system"?

Big pain in the ass but I managed to raise enough of a fuss to get them to fix it. I'm trying to prove you wrong so you don't give people wrong advice. His only recourse is to file the dispute but he needs to be prepared for the seller to try something like this.

Its a well known scam on ebay to delay shipping until buyer files INR dispute and then send broken crap since paypal limits you to 1 claim per person.

Well instead of just trying to prove him wrong how about offering your advice on the steps to take since you have been through this. Ok I got that you say not to file a paypal claim till you get the item. But if he doesnt send what? Call your CC company as others have stated, or do you go to ebay or what?

Question. To all those that said that they got the persons info and then called them over the phone. How did you get this info? Iv checked at ebay and paypal and dont see any info that helps. The guys name is listed as Kyle Head but that could be made up easy and gives me no clue where he lives or anything.
 
Update so the guy just messaged me with this. Hopefully its true.

"sorry i sent it out yesterday but i went to detroit and just got back and the tracking is in the car i wil get it in the morning and e-mail it to you. sorry again about the delay"

Just be wary of him continually either forgetting to send or eventually losing the tracking number. That would be a big red flag for me. Basically just don't let him stall you past the deadline to file a dispute.

The way I'd deal with a scam such as Brian laid out is (1) file mail fraud charges on the seller and (2) escalate to a dispute with my credit card. And if you are really pissed off/motivated you could look into filing charges with his local police, assuming you have a valid address on the guy.

Do the PayPal dispute first and then if they screw things up in one of the number of ways that can happen you go to the CC which tends to take care of customers a little better.
 
I bought about 4 mattel '78 hand held video games on ebay on separate purchase, all went well. the fifth the seller (different every time) sold me a non-working game, and refused contact. I put true feedback (the game did not work and he was unresponsive), and the seller wrote i had been harassing him, threatening, hangups, etc.

Never bought on ebay again... (but did get my money back)

Ya just because he responded that way doesn't mean im going to assume everything is ok. I plan on waiting till tomorrow and if I haunt heard back with a tracking number ill message him again. Next Tuesday marks the 2 week mark. If I dont have my system or know for sure via a tracking number im starting claims.

That kinda raises a red flag. Is it a 3rd party card? Cause I know all first part cards fit in a fat or slim PS2 with no problem.

It worked......I just did the stupidest thing in the world and tried to put it in the controller slot. Iv been playing games 20+ years and did something that fucking stupid. Anyways it works, iv played some We Love Katamari, Culdcept and Guitar hero with no problems. FFXII Collectors Edition had a big scratch on the game disk I didnt notice, but hell im happy to just get the system and mem card for $85 shipped, forget the extra games.
