The aggregate Approximate Retail Value of all prizes $1694.97. Sponsor, in its sole discretion, shall determine which model of the Prize to be awarded, in accordance with the terms hereof. The Giveaway begins at 12 a.m. Mountain Time on February 15, 2006, and ends at 12 a.m. Mountain Time on March 8, 2006. Sponsor will give away one (1) Prize each week to a qualified Entrant on or about February 23, 2006; March 2, 2006; and March 9, 2006 ("the Giveaway period"). Any federal and state taxes on a prize are the sole responsibility of the Winner. No substitution or transfer of prizes is permitted, except at the sole discretion of Sponsor. ELIGIBILITY: The "GET YOUR GAME ON GIVEAWAY" ("the Giveaway") is open only to legal residents of the United States (excluding Puerto Rico, the U.S. Virgin Islands, and other commonwealths, territories, and possessions), who are 18 YEARS OF AGE OR OLDER as of February 15, 2006 ("Entrant" or "Entrants"). Employees, their immediate families (spouses, parents, children, siblings, and their respective spouses), and household members (whether related or not) of Overstock.com ("Sponsor"), and its affiliates, subsidiaries, divisions, advertising and promotion agencies (collectively, including Sponsor, "Giveaway Entities") are not eligible to enter. HOW TO ENTER: During the Giveaway period, Entrants will automatically be entered for the giveaway on any day Entrant makes a purchase from Overstock.com (not including auction purchases) ("Purchase"). One Purchase per household per calendar week during the Giveaway period will automatically enter a qualified Entrant up to a maximum of three (3) Purchases. Alternatively, Entrants may enter without making a purchase by printing and delivering the entry form provided below to the address noted therein (limit of one such entry per Entrant per calendar week up to a maximum of three (3) such entries) ("No-Purchase Entry"). No-Purchase Entries will be eligible for the next giveaway after receipt by Sponsor. Entrants may begin sending No-Purchase Entries on February 15, 2006 for eligibility during the Giveaway period. DETERMINATION OF WINNERS: Prospective Winners will be selected in a random drawing conducted by Sponsor at its place of business from among all eligible entries received by the deadline of the day of the drawing. Sponsor will notify Prospective Winners by phone and/or email after the drawing. The Winners will be determined after the random drawing, notification of Prospective Winners by Sponsor, response from Prospective Winners, completion by Prospective Winners of required forms and agreements, and verification by Sponsor of the Prospective Winners' eligibility. Sponsor, in its sole discretion, shall choose the Winners.
PRIVACY: Personal information submitted in connection with the Giveaway shall be treated in accordance with these Official Rules and Sponsor's Privacy Policy located at http://faq.support.overstock.com/?docID=12. If an Entrant chooses to opt-in to receive additional email communications from Giveaway Entities, such information shall be subject to the respective Giveaway Entity's privacy policy and terms of service.
PUBLICITY: Unless where permitted by law or Sponsor's Privacy Policy, winner grants to Sponsor and Sponsor' licensees, affiliates and assigns, the right to print, publish, broadcast and use, worldwide, in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, the winner's name, portrait, picture, voice, likeness and biographical information as news or information and for advertising and promotional purposes without additional consideration; and further without such additional compensation, or provide biographical information for use in, any presentation or other activity which may include filming/audio/video/electronic or other recordings and/or interviews as may be determined by Sponsor. Failure to grant such rights may result in disqualification with an alternate winner or potential winner selected from eligible entries previously received and in accordance with these Official Rules.
GENERAL CONDITIONS: Sponsor reserves the right to modify, suspend or terminate the Giveaway by giving such notice in any form and manner deemed appropriate by Sponsor, in which case, all prizes will be awarded from eligible entries previously received up to and or after (if applicable) the modification, suspension or termination date and in accordance with these Official Rules.
