$40 for a game that came out less than a month ago? Good luck, and i don't mean to sound rude, just the only way you'll get it for $40 is game only, no case, no manual.
 
You can get it for $44 at Gamestop currently if you use the 20% off coupon that has been posted in one of the deals threads. I went to Gamestop last night, and they had at least 5 used copies. That may be your best bet.
