No its worse then a used one. Its a store return of everything a electronic could be (i.e refurb, open box etc) The only thing I would not buy is a return.

cant the serial #s are scaned when they are bought

If you look on a 360 box, or any of the new ones, they always have a little "window" to the inside showing the Serial number and a barcode on the sticker that is on the console.
