The policy for damaged/broken systems is as long as you contact Nintendo directly for a replacement, content transfer is standard practice. Systems that are lost or stolen will not have their content recovered.
About 2 and a half years ago, I sold my original 3DS (Ambassador certified) after formatting it due to a dire financial situation. Recently I acquired a 3DS XL and am quite happy with it..except with Mario Kart 7, also known as the hand killer (I need a grip, I know).

Being a former M.A.M.E. cabinet owner who had to sell his due to lack of space, this may be perfect for me. I'm already thinking mods for it, such as a lighted marquee, overlay and side art.
It makes no sense that Nintendo has not yet given us 3DS owners access to Super NES and GBA (minus Ambassadors which proves it can be done easily). Hopefully we see something over the horizon soon.
Good to know. Guess they stopped allowing that after the Nintendo ID system began? I have 2 3DS, 2 DS Lites and 3 Wiis (how did I do that?!) registered.
