If i remember correctly, in the past certain game consoles would leave their SN exposed to be scanned by the store. This should become common practice anymore with all of the thefts and such. Not sure if the benefit outweighs the cost to incorporate something like this, but it would stop a lot...

Possibly once you update the system, it loses the pairing and has to re-recognize the controller. About the size of the download. I don't think they update pieces of it. I think they force you to get all of the code, even if it isn't needed. They may change this in the future b/c I can imagine...
