i know the regular 3ds model has a design flaw where the bottom screen will leave a mark on the top when its closed and can actually scratch it. I noticed this when i was warned about it and i keep the little foam piece in it when its closed.

I was wondering if the XL has the same problem, or if the fixed that on it. I dont think Nintendo ever even acknowleged the issue despite all the complaints

I've heard people complain about that the XL still has that problem. I bought an XL a few months ago. Truth be told when I close the XL and look at it from the side I can see a small gap between the two halves that keeps them from touching. I don't think they could the screens could scratch each other even if I tried. Nintendo could have made a slight modification to the XL since it launched that prevents the problem from happening.

Yeah, I take my 3DS quite often on the go with me since I bought mine back in early April. It's a limited edition Pikachu version. Just last week I was looking at my top screen and noticed it has scratches from the lower screen. Unfortunately I hadn't bought any scratch shields for it and now am left with scratches. So the problem has not been resolved. I'll have to live with it unless Nintendo will do something about it or I go ahead and swap out the screens myself or pay someone to do it. Bleh.
