Did I get scammed?

I bought a doll for my mom from a seller outside of ebay and I payed with Paypal, I payed him the money and he said he would ship it as soon as the money was in his bank account. He shipped it with deliver confirmation and I signed when it arrived. When I got it the dolls head was broken. It looked to my mom that the doll had been taken out before (which he stated he didn't) and when placed back it wasn't correctly so she had no support and her neck must have snapped because of that.

I took some pictures and emailed him only to get a reply telling me that I was trying to scam him and that he wasn't going to fall for it, that he put a "secret" mark on the doll so he knows thats not the one he sent and he went on and on about stuff about how I signed for it and whatnot. I also had another email from him were he said he contcted Paypal through email and phone and told them I tried to scam him and that he had nothing to worry about.

After all that it seems like he is the one who scammed me since it appears he had everything planned for what he would do when the doll arrived to me broken. The doll was expensive and my Mum is pretty bummed, I don't know what I can do in this case, will paypal help? Will paypal believe that I somehow tried to scam him (i was the one that payed money how could I scam anyone?), This has never happened to me so I am clueless on what to do I have never had problems with ebay or paypal.
 
It was a bad idea to go outside of Ebay, but I still think you can do a chargeback through Paypal. That secret mark thing is interesting - how did he put a mark on it if he never took it out of the box?
(Or am I misunderstanding something).

He sounds kind of desperate...what's his feedback?
 
Huh, a new case of scams: the person sending you a busted up item, and at first sign of the other person realizing it's a scam, they claim that the item was broken and call PayPal to report a scam. So then who will PP believe? Funny.

Sorry friend, but I do believe you are the victim of a scam. I would second the PP chargeback.
 
Chargeback.. Paypal doesnt really listen to people, so him calling paypal is a lie. I'd stop talking to him in a civil manner and start cussing his low life ass.
 
I payed with the money on my paypal account and I only have a debitcard registered on paypal can I still do a chargeback?

Sorry I'm new to this since its never happened to me.
 
Start a dispute on Paypal with "item not as described" being the reason. It's obvious that it was damaged before he shipped it & just passed the blame to whoever delivered it to you.

If that doesn't work, talk with your bank on how to file a chargeback. Even though it's a debit card, you can still file chargebacks.
 
I had a eBay seller do that to me when I bought a sleeping back off of eBay for a friend. When my friend got it, the sleeping bag had a rip in it and the guy tried to say he puts a special mark on each one of his sleeping bags that he ships out.

I filed a dispute and lost though. The funny thing is I emailed other people who bought sleeping bags from him and they had no marks on them. I showed this to paypal and gave them the other buyer's email addresses but still lost.

Yea, if it was listed as "never removed from box" and then he even says he removed it to put a secret mark on it then its not as advertised.
 
Fuk filing a dispute with Paypal, just file a chargeback..doesnt matter if its a debit card, if you dont really file a lot of chargebacks you are automatically right in your banks eye.
