This guy is a jerk. But to say it's fraud is stupid. It's not fine print people, it's one of the three paragraphs in the auction listing. If you don't read the info before buying tough.
I personally deal with people who don't think they have to follow the rules and terms they agree to before making purchases on a daily bases. Put it out there plain as day to see and you aren't responsible.
Let me ask you this - Is he deliberately trying to mislead people for his own gain?
I assume your answer is yes. That is the exact definition of fraud.
I do believe that he is hoping you don't read through the auction clearly, yes. However, he is not responsible for those who would bid on a legal biding contract without reading what it is they are bidding on.
Actually thats not true. You can't hide information in the middle of a contract hoping that someone doesn't see it. I learned that in college in a business law class. I understand that there are idiots on ebay who need to read more about auctions, but in this case he was deliberately trying to hide the information.
I'm not going to make this a back and forth, because in the end I don't really want to defend this guy.
His auction description states this is info not a product. It's not "hidden" at all. It's also not hidden in the contract as you put it, the conract is the one you enter into when placing a bid on any item. The description of the item was clear what you were getting. If he wanted to be a better person he could have separated the info from the paragraph, mabye even highlighted it. But again, the fact that he didn't is not going to sway the fact that people bid on something he stated was info, not a PSP.
